2、偿获得宅基地的使用权，但法律规定宅基地使用权的继承在农村被严格禁止。宅基地使用权继承的限制不仅与现有的中国《物权法》和《继承法》的相关规定相矛盾，也使农民通过宅基地使用权获取经济价值的权利受到极大的限制，同时损害了农民的切身利益。目前实践中暴露出的越来越多的宅基地使用权继承纠纷，集中反映了我国宅基地立法的缺陷，这一矛盾能否顺利解决直接影响到农村土地市场的稳定以及农村经济能否得以顺利发展。笔者认为，目前我国宅基地使用权继承制度立法与现实需求严重脱节，因此本文在对我国宅基地使用权继承的相关法规与司法实践的研究基础上，结合《继承法》的基本原则和宅基地

3、使用权的用益物权属性分析，提出宅基地使用权继承制度的建立的必要性和可行性。同时，在确认宅基地使用权继承的基础上，分析不同主体在行使该继承权可能面临的理论困境，提出解决问题的思路，并进一步提出完善宅基地使用权继承制度的意见和建议。关键词：宅基地使用权,农村集体组织,用益物权,继承法IAbstractThepurposeofthisstudyistodiscussthenecessityandfeasibilityoftheinheritanceofrurallanduseright,andtoprovidesomesuggestionsonthe
