2、司法机关带来了新的挑战。对比以前的赌博，新型赌博活动具有花样多，隐蔽性强，范围广等特点，而我国刑法对赌博罪的规定却是非常粗糙和滞后的，对于赌博的相关研究也是相当的肤浅。现行立法的缺陷直接导致司法实践的混乱和争议。与此同时，在世界掀起非犯罪化的思想浪潮下，我国有一些学者提出了将赌博非犯罪化的观点。因此，赌博罪在我国的存废就成了争论的焦点。确实，我国现行赌博罪的立法存在缺陷：在罪名设置上，没有规定“普通赌博罪”，一些新型“赌博”行为也没有纳入；在构罪要件上，“以赌博为业”难以认定，“以营利为目的”的规定不科学，主体不完善；在刑罚配置上，
