2、果的权利滥用行为。美国、欧盟和日本等国在反垄断法规制专利池滥用方面积累了丰富的经验。主要包括：反垄断法或执法指南中增加专门针对专利权或专利池滥用的规定；将限制性条款进行分类以提高反垄断的可操作性；以及明确抽象的合理原则的具体判断标准等。虽然我国《反垄断法》有关于规制知识产权滥用的原则性规定，但是由于缺乏专利权和专利池滥用的专门规定，仅存的规定不足以规制这种滥用行为。因此，有必要在借鉴国外（地区）经验的基础上，完善反垄断法固有缺陷，制定专门针对专利池滥用的相关规定，同时还应妥善解决与其他法律制度的适用竞合关系。关键词：专利池滥用反垄断
