1、摘要行政诉讼原告撤诉制度，是行政诉讼的重要内容，也是法院结案的重要方式。它不仅直接反映诉讼程序的实施状况，而且体现了行政诉讼对当事人权利的救济程度。行政撤诉制度设置的合理与否，关系到诉讼价值目标能否实现。我国行政诉讼法自颁布以来，撤诉率一直居高不下，近几年来甚至出现逐年增高的趋势。特别是非正常撤诉大量存在，使得撤诉制度的实施状况不尽如人意。司法实践中，法官大量运用协调和解撤诉机制，致使意图在维护当事人合法权益的司法审查权在现实中落空，法律的权威性因而受到冲击。本文基于实证分析、比较分析和法律逻辑推演等

2、方法，试图寻求改善我国行政撤诉制度的合理路径。首先分析撤诉的基本理论，从行政撤诉的概念入手，阐明撤诉制度的法理基础、阐述与撤诉制度相关的行政诉讼协调机制理论；紧接着分析两大法系代表国家和地区关于撤诉制度的立法规定，同时对比我国撤诉制度的立法和司法现状，进而找出我国撤诉制度存在的不足，得出造成目前非正常撤诉大量存在的原因既有政治体制的原因，也有不合理的法律制度的因素，还与司法实践中各诉讼主体有关。最后，阐明在借鉴国外立法经验的基础上，从优化司法环境以维护法律权威，坚持行政诉讼的指导原则和明确行政诉讼目的
