1、摘要正义作为法律的价值原则，它对法律内在精神的确立和法律运行的协调与平衡有着必然的影响。它对法律的影响主要体现在法律制度的确立与程序的运行。研究法律运行中的正义的逻辑起点是法律制度和程序自身应具有正当性。通过分解宏观的制度和微观的程序来认识它们的价值原则，从而确定在制度建立与程序设计时应该遵循的价值标准。本文认为，程序正义是实质正义的保证。制度的确立和程序的设计应当体现法律对正义的追求。法律制度所追求的正义主要是从制度本身和制度与程序之间建立的协调关系来实现的。本文共分三部分：第一部分为法律运行的内含及

2、特征。主要论述了法律运行的宏观特征和微观特征以及法律运行中形成的正义的性质；第二部分为法律运行中制度和程序的正义。主要内容为法律制度的静态结构和动态结构关系以及制度与程序之间的良性运行以保证正义的实现；第三部分为制度与程序正义在法律运行中的体现。主要内容为制度与程序正义对法律运行的制衡与调节，法律运行中的制度正义与程序正义。关键词：法律运行正义制度程序AbstractThevalueofjustice，asalegalprinciple，itsinnerspiritofthelawandlegalope
