1、摘要随着企业专利保护意识的不断增强，企业之间的竞争逐渐演化为技术创新能力的竞争。在双寡头市场中率先拥有专利技术的一方为领导者，另一方为跟随者。先研发成功的企业往往会申请专利保护其创新技术，以防止竞争对手的模仿，保持其技术的主导地位。本文考虑领导者专利的生命周期，讨论跟随者的策略选择以及领导者的许可策略和专利诉讼策略。主要包括以下内容：首先，分析了在领导者不许可其专利时，跟随者的策略。研究结果表明：如果跟随者的研发效率较高，那么跟随者进行研发投资且最大化其研发投资系数；如果跟随者的研发效率较低且模仿成本较低，那么跟随者将模仿领导者的专利技术；否则，跟随者放弃使用专利技术。其次，探讨了领导者的专利
