1、中文摘要随着代理制度的产生并普遍应用于商事交易，使商事代理制度逐步发展并不断完善，在经济全球化的大背景下，商事代理应用十分广泛，并产生了带有涉外因素的国际商事代理。而商事代理权作为商事代理制度的核心权利内容，在权利的主体、权利的产生、行使及消灭等方面与当事人间的权利义务关系戚戚相关，直接影响着整个商事交易的稳定和安全。本文主要通过比较分析的方法来了解英美法系与大陆法系中商事代理权相关规定的异同，在求同存异的情况下探讨两大法系在立法中是如何应用并发展，结合我国的具体规定了解我国现有制度的不足之处，提出笔者的相关见解。关键词：代理；商事代理；商事
