2、行政法制监督的功能在于防止滥用权力、以权谋私和权力异化，保证政府职能实现，维护社会公共利益和公民权益。对行政法制监督问题进行研究的意义在于分析现行监督制度的优劣，完善我国的监督制度，确保其发挥预期功能。权力的属性、行政权的特征和中国的国情决定了我国目前亟需加强行政法制监督。古代中国的监察制度和现代西方国家对行政权的监督制度，对我们加强行政法制监督富有借鉴意义。我国现行行政法制监督包括执政党的监督、权力机关的监督、司法机关的监督、行政系统的内部监督、人民政协、民主党派和人民团体的监督以及社会公众监督，这一体制尽管有其优点，但也存在重大而明显的缺陷，监督效果很不理
