2、ntheactualwagelevelitpaysallpersonnelwithsimilarexperienceandqualificationsholdingthespecificpositioninquestionortheprevailingwagelevelfortheoccupationalclassificationinquestion,whicheverwagerateisgreater.Fortheactualwagedetermination,theUHhiringcollegeordepartmentmustreportinwritingthemethoduti
3、lizedtodeterminetheactualwageleveltobepaidtheH-1Bemployeeinquestion.Tohelpdocumenttheactualwagedetermination,providedaretheenclosed“ActualWageDeterminationStatement,”inwhichthecriteriausedfordeterminingtheactualwageisreported,and“ActualWageDeterminationWorksheet,”inwhichthewageratespaidtotheempl
4、oyeesinthesamepositionwiththecollegeordepartmentarereported.IfthewageofferedtheH-1Bemployeeisdifferentthanthatpaidtotheotherlistedemployees,explanationmustbeprovidedintheavailablesectionoftheworksheet.Ifthereisnootheremployeeholdingthepositioninquestionatthecollegeordepartment,thewageofferedtoth
5、eH-1Bemployeewillbetheactualwage.TheDepartmentofHumanResources(HR)willprocesstheprevailingwagedetermination.Determinationoftheprevailingwageisbasedonoccupationalclassification,geographicallocationofintendedemployment,supervisoryduties,andpositionrequirements:education,experience,andspecialrequir
6、ements.Iftheprevailingwageishigherthantheofferedactualwage,HRwillcontactthecollegeordepartmenttonotifyanddiscussoptions.Actualwageandprevailingwagedeterminationdocumentationwillbecollectedandplacedininspectionfolders,asrequiredbytheDepartmentofLabor,atHR.Questionsregardingactualwagedetermination
