1、-3-ActualWageDeterminationFormPertheUSDepartmentofLabor’sregulations,anemployerintendingtohireanH-1B/E-3nonimmigrantmustagreetopayeithertheactualwageorthecertifiedprevailingwage,whicheverishigher,throughouttheauthorizedperiodofH-1B/E-3employment.Theactualwageisdefinedasthewageratepaid

2、bytheemployertoallotherindividualswithexperienceandqualificationssimilartothoseoftheH-1B/E-3nonimmigrantforthespecificemploymentinquestionandattheplace(s)ofemployment.ThewagerateistherangeofsalariespaidtotheotheremployeesemployedintheoccupationandNOTtheaverageofthewagerates.Theactualw

3、agealsoincludestheemployer’sobligationtoofferbenefitsandeligibilityforbenefitsprovideascompensationforservicestotheH-1B/E-3nonimmigrantonthesamebasis,andinaccordance,withthesamecriteria,astheemployerofferstoU.S.workers.WhenthepayisadjustedfortheotheremployeesduringtheH-1B/E-3authorize

4、dperiodofemployment(LCA),suchadjustmentshallbeprovidedtoallsimilarlyemployedH-1B/E-3nonimmigrants,unlesstheprevailingwageishigherthantheadjustedactualwage.Suchexamplesofpayadjustmentsarebutnotlimitedto:costoflivingincrease,periodicadjustments,ortheemployeemovestoamoreadvancedlevelinth
