1、摘要我国非诉行政执行制度是我国行政法发展历程中的产物，非诉行政执行是指公民、法人或者其他组织既不向人民法院提起行政诉讼，又拒不履行已生效的具体行政行为所确定的义务，行政机关或行政裁决确定的权利人、继承人或权利承受人向人民法院提出执行申请，由人民法院采取强制执行措施，使行政机关的具体行政行为所确定的义务得以实现的制度。其性质应是司法性质。非诉行政执行的法理基础即司法控制下的行政执行。由于行政权天然的扩张性和行政诉讼的滞后性，因此，无论从分解行政执行权的行政立法需要考虑，还是从控制行政执行权的司法滞后现状考虑，非诉行政执行制度都有其存在的必要性

2、。针对我国现行非诉行政执行制度存在的主要问题：申请主体单一化，申请期间不统一，审查标准不明确，执行机构不规范。作者提出以下完善措施，即：重构非诉行政执行制度的申请主体，统一非诉行政执行的申请期间，完善法院对非诉行政执行的审查，明确法院非诉行政执行的执行机构。在此基础上，作者对构建非诉行政执行的听证程序、和解程序进行了探讨，力求进一步完善我国现行非诉行政执行制度。关键词：非诉行政执行控权2AbstractThesystemofnon-litigiousadministrativeexecutionisaresultinthedevelopmen
