2、、保障人权的刑法机能。本文通过介绍、比较国内外关于犯罪构成(犯罪成立意义上的)各种学说，在立足于本土资源的基础上，摒弃犯罪客体作为犯罪构成之要件。另外，站在客观主义的刑法立场上，将犯罪主体要件、犯罪主观要件、犯罪客观要件按照犯罪客观要件——犯罪主体要件——犯罪主观要件的序位进行排列。从而使得重建后的犯罪构成理论更能体现罪刑法定主义的现代刑事司法原则，更有利于被告人及其辩护人做出罪的辩护，更有利于法官判定罪与非罪，最终实现刑法限制权力，保障人权的机能。关键词：犯罪构成构成要件序位思考Toourcountrycurrentlyin
