1、ASBESTOSRELIEFTRUST:RELEASEANDDISCHARGEFORMRELEASEANDDISCHARGEINFAVOUROFTHEGENCORGROUP,THEGEFCOGROUPANDTHEMSAULIGROUPGRANTEDBYACLAIMANTWHO(i)HASHIMSELFORHERSELFCONTRACTEDANDARD;(ii)ISADEPENDANTOFAPERSONWHOHASDIEDFROMMESOTHELIOMAORASBESTOS-RELATEDLUNGCANCER("THEDECEASED");(iii)IST

2、HEDULYAUTHORISEDREPRESENTATIVEOFTHEESTATEOFTHEDECEASED1.Inconsiderationof:1.1thefoundingoftheTrustbyGencor,GefcoandMsauli;and1.2thepaymenttotheTrustbyGencoroftheGencorSettlementAmountandbyGefcooftheGefcoSettlementAmountandbyMsaulioftheMsauliSettlementAmount;and1.3theacceptancefor

3、considerationand/orpaymentbytheTrustofmyclaimformoniesarisingoutofARD,Iherebyirrevocablyandunconditionally:i)releaseanddischargeallmembersoftheGencorGroup,allmembersoftheGefcoGroupandallmembersoftheMsauliGroup(jointlyandseverally)fromanyclaim,proceedingoraction(actual,potentialor

4、contingent)whichIhaveormayhaveagainstthem(jointlyorseverally)relatingtoARD;ii)agreeandundertakethatIwillnotbringanyclaim,proceedingoractionofwhatsoevernatureandhowsoeverandwheresoeverarising,againstanymemberoftheGencorGroup,anymembersoftheGefcoGroupandanymembersoftheMsauliGroup(j

5、ointlyorseverally)relatingtoARD.2.Therelease,discharge,agreementandundertakingreferredtoin1abovearegivenandmadebyme(deletewhicheverof2.1,2.2or2.3isnotapplicabletoyou):2.1inmypersonalcapacityasapersonwhoissufferingfromARD;or2.2asthelegaldependantofapersonwhohasdiedfrommesothelioma

6、orasbestos-relatedlungcancer;or2.3inmycapacityasthetrueanddulyauthorisedrepresentativeoftheEstateofapersonwhohasdiedfrommesotheliomaorasbestos-relatedlungcancer,inwhicheventIwarrantmycapacityassuchandIagreeandundertaketotheTrustthatanymoniespaidtomebytheTrustwill:2.3.1beinfulland

7、finalsettlementofallandanyclaimswhichanylegaldependant/softhedeceasedmayhaveagainsttheTrust;2.3.2bedistributedbymetothelegaldependant'softhedeceased.3.ThisReleaseandDischargeisgivenforthebenefitofthemembersoftheGencorGroup,theGefcoGroupandtheMsauliGroup(jointlyandseverally),astho
