1、AbstractThelegalsystemofdefectiveproductrecallemergedinU.S.Ainthesixtieslastcentury,becauseitpaysstressontheprotectionsofconsumers’interestsandtheenhancementsofenterprises’competitiveness,ithasbeendrawnlessonsfromandadoptedbynumerouscountriesafterwards,andhasbecomeacurrentlegal
2、systemintheworldgradually.OnMarch15,2004,theHeadOfficeofNationalQualitySurveillanceandQuarantine、NationalDevelopmentandReformCommittee、DepartmentofCommercealongwithGeneralAdministrationofCustomshavejointlydrawnuparegulationtomanagethedefectiveproductrecallofallautomobiles,which
3、hasbeencarriedoutfromOctober1.Thepromulgationoftheregulationhasindicatedthatthelegalsystemofdefectiveproductrecallhasalreadyenteredthestartingstageinourcountry.Buttoday,undertheinfluencesofthemarketeconomyandthejoiningofWTO,themarketandtheproductshavebeenofdiversification,theex
4、tensionandconnotationofproductshavebeenexpandedconstantly,soitisfarfromenoughthatourcountryhasonlytheregulationofmanagingthedefectiveproductrecallofallautomobiles,thelegalsystemofdefectiveproductrecallshouldextendtonumerousfieldsofproductsthatmaycausedangertothepublic.Therefore
5、,it’sparticularlyurgentforourcountryhowtostructurethelegalsystemofdefectiveproductrecallwithfullofscienceandcompleteness.Truly,toanykindoflegalsystem,itsconstructionisnonesimple.Anykindoflegalsystemshouldbeenbasedonthesolidfoundationsoftheories,Tograspthetrendsofitsdevelopment,
6、throughtracingbacktoitshistoricalbackgroundsaboutitsorigin;toknowitsvalueorientationcorrectly,throughprobingintoitsattributeoflegaldepartment.Meanwhile,toanykindoflegalsystem,itsconstructionisnoneindependent.Anykindoflegalsystemshouldusethebeneficialdemonstrationexperiencesofth
