1、摘要缺陷产品召回法律制度最早出现在美国。随后，英国、加拿大、日本、澳大利亚等发达国家也相继建立缺陷产品召回法律制度。美国将该制度首先应用于汽车行业，此后逐渐将缺陷产品的范围扩大到一般消费品、食品、药品、医疗器械、化妆品等领域。缺陷产品召回法律制度在美国等发达国家的实践表明：该制度是产品质量和消费者权益的有力保证，实施缺陷产品召回法律制度有利于提高制造者的产品质量意识，有利于企业关注技术改造和环保问题，有利于规范市场竞争秩序。因此，加强对我国缺陷产品召回法律制度的研究具有十分重要的现实意义。通过对我国缺陷产品召回法律制度相关概念的界定，对缺陷产品召回法律制度及其相关法律问题进行辨析，

2、阐述了缺陷产品召回法律制度的社会救济、企业发展、政府监管功能及其现实意义。在考察我国缺陷产品召回的立法现状以及国外的先进范例的基础上，分析了我国缺陷产品召回法律制度存在的立法缺陷与实施障碍。立法缺陷主要体现为立法层次低、立法内容界定不明确等；实施障碍则主要表现为市场准入监管不规范、鉴定机构缺乏以及职能交叉重叠等。针对这些立法缺陷与实施障碍，提出了革新我国缺陷产品召回法律制度的路径，即明确我国缺陷产品召回的主体，统一缺陷产品的认定标准，确定缺陷产品召回责任的归责原则，完善缺陷产品召回的配套制度以及程序。运用比较分析法、综合归纳法等研究方法，从法律角度对我国缺陷产品召回法律制度进行研究
