1、摘要社会主义和谐社会是能够协调各方面利益关系，化解社会矛盾的社会，建立行政争议解决机制，完善行政救济体系是和谐社会的应有之意。行政争议解决机制的建立是对行政救济制度实现的程序保障，我国现已颁布实施了《行政复议法》、《行政诉讼法》、《国家赔偿法》、《信访条例》等一系列有关行政救济的法律、法规，从而使公民的基本权利在受到行政机关侵害时，能够受到实体法的基本保障，但是仅有相关制度的法条的罗列并不代表行政救济制度的完善，如何将与行政救济制度相关联的构成要素通过科学的方式予以规范，使其形成一套运行有序、相互衔接、保障有力的制度体系，从而更好的保障公民的基本权利的实现

2、，这正是本文的研究意义之所在。文章首先阐述了行政争议解决机制的理论基础，分析了行政争议的内涵、特点、包含元素等内容；其次对我国现行的解决行政争议的制度手段进行了分析，其中分别对行政争议的司法救济手段、行政救济手段以及立法机关的监督救济手段进行了研究，并分析了整体制度的衔接问题，从而找出限制我国纠纷解决的制度瓶颈之所在；第三部分对域外行政争议解决机制进行比较研究，借鉴英国、法国、日本等国家的做法，提出了对完善我国现行制度的启示；最后，文章在对我国制度瑕疵的客观分析的基础之上提出构建多元化纠纷解决机制的设想，描绘了构建我国行政争议解决机制的宏图。关键词行政争议
