1、摘要近年來，随着城市化进城的加快，我国公民的生活水平也在普遍的提高。不动产的征收也为此起到了一定的积极作用，但随Z引起的纠纷也频频发生。违法征收，强制拆迁所引发的一系列不愉快，甚至是暴力流血事件在不断上演。最主要是因为公共利益的界定及公益与私益保护的失衡。虽然我国于2011年通过并施行了最新的《国有土地房屋征收与补偿条例》屮对公共利益的界定作了进一步的完善，但因各种现实复杂因素的制约，《国有土地房屋征收与补偿条例》对公共利益的具体界定及其实现仍存在不足Z处。本文拟对不动产征收中公共利益的界定及实现作一下探讨。从一个案例一一253户洛阳老城区居民状告政府“非法拆迁”一案出发
