1、99版FIDIC施工合同条件下业主方预防工程索赔的研究摘要工程索赔是工程合同当事人保护自身利益的一项重要措施，是工程合同管理的核心内容，日益引起工程承包界的重视。但是当前建筑市场上承包商过分强调索赔，甚至完全依靠索赔来获得利润，这样做不仅会给自身带来很大的风险。为了帮助业主提高自己的索赔管理水平，正确的理解索赔并且预防索赔，本文通过对FIDIC合同条件1999年版的详细分析，指出在FIDIC合同条件下，业主需要预防索赔事件发生的条款，索赔发生的原因，并且针对每项条款都提出了承包商索赔的管理关键点。

2、本文对业主索赔的预防与处理工作进行了详细的论述。对于业主索赔预防的工作，从系统的角度，通过对索赔风险进行识别，包括索赔风险识别的方法和原则，界定出整个工程索赔的风险因素，结合业主需要预防的索赔条款，识别出业主需要预防的索赔风险，再按照针对索赔风险的控制措施，制订业主预防索赔事件发生的具体措施。为了帮助承包商提高索赔处理的水平，本文从工程所需面对的全部风险入手，将其分类，详细写出业主所需承担风险，同时根据合同条款，逐一进行风险识别并提出预防措施，并根据索赔产生的4条主要原因进行重点说明，从而加强业主
