1、FIDIC合同条件下业主索赔管理研究摘要近年来，我国的建设项目体制和项目管理理论得到了很快的发展，但相对索赔经验丰富的承包商而言,我国业主方的索赔管理水平要落后很多,从实践经验看,我国业主方的索赔管理还处于初级水平，而业主索赔管理是合同管理的一部分,在合同履行过程中业主方需要通过正确预测,寻找索赔机会,科学地预防索赔,合理地处理索赔,解决索赔争端,保证合同完全履行来维护自身的合法权益。因此,加强建筑工程业主方索赔管理的任务十分紧迫，提高索赔意识,加强索赔管理已成为当务之急。本文研究的主要内容包括：新版FIDIC施工合同条件
2、及其索赔条款的分析，这是本文研究工作的条件；业主索赔管理概况的研究，通过研究业主索赔管理的基本概况，为后面的研究奠定基础；业主索赔防范措施的研究，分析了工程建设中常见的几种承包商索赔原因，提出一些业主索赔防范的有效措施，帮助业主预防索赔事件发生；业主反索赔研究，包括业主主动对承包商进行索赔和反驳承包商索赔两方面内容。本文侧重于业主防范承包商索赔的措施研究，其目的是为了使业主认识到索赔防范的必要性，增强索赔意识，有效地防范和处理索赔事件，提高合同管理水平，有效保障业主的合法权益不受侵害。关键字：建设项目FIDIC合同条件业主
