1、天津理工大学2008届本科毕业设计论文在FIDIC合同条件下业主对施工索赔的预防摘要工程索赔是业主和承包商双方在工程实施过程中发生的重要业务活动，其实质上是业主和承包商对相互间承担风险的再分配，在施工合同的履行过程中发挥着巨大作用。工程索赔的发生都是由一定的索赔诱因引起的，业主方可以加强对引起索赔诱因风险因素的管理，来预防施工索赔事件的发生，减少工程变更与额外支出。论文依据FIDIC合同条款介绍了业主方索赔管理的体系结构、导致索赔的因素、施工索赔的一般程序及索赔争端的解决途径。在工程风险定义的基础上，研

2、究了风险转移与工程索赔的关系。从随机不确定性的角度出发，分析了索赔风险产生的一般机理，将各种工程风险进行了分类。将不同索赔诱因所面对的风险因素，应用不同的风险识别方法进行了识别，根据识别出的不同风险因素提出了业主方应采取的控制措施。并且将索赔诱因的风险识别，分析与预防的过程进行了总结，形成了一个系统的基于风险的业主方预防施工索赔管理手册。最后结合XX建筑大学东校区一号教学楼的工程实例，验证了业主方预防施工索赔管理手册在实际中的作用。关键词：业主方施工索赔预防索赔风险管理Owner’sPrevention
