1、论合同目的THEORYAIMOFTHECONTRACT摘要：合同目的是指合同双方当事人通过合同的订立和履行，所期望获得的利益或者欲达到的某种状态，其与合同动机有着本质的区别。合同目的依据不同的标准可以进行不同的分类，在实践中准确查明合同目的具有重要的法律意义。合同目的之性质是否合法决定了合同效力的有无；合同目的之实现与否影响了合同解除权的产生与否；合同目的对根本违约和重大误解的认定也起着决定性的作用；而且合同目的在合同的实践和合同纠纷的审判中同样具有重要作用。在合同中明确合同目的具有重要作用：其一，确定合同当事人的权利义务
