4、eesandthirdpartybeneficiaries,andremedies.Ithas,toaveryconsiderableextent,preserveditsunitaryquality,resistingfundamentaldistinctionsbetweendifferentclassesofcontractsaccordingtoeitherthesubjectoftheagreementorthenatureoftheparties.Accordingly,withsomeexceptions,it
5、sprinciplesareapplicabletoagreementsonsuchvariedsubjectsasemployment,saleofgoodsorland,andinsurance,andtosuchdiversepartiesasindividuals,businessorganizations,andgovernmentalentities.Itislargelystateratherthanfederallaw,butitdiffersusuallyonlyindetailfromonestateto
6、anther.Whileitisstillprimarilycaselaw,anincreasingnumberofstatutesdealwithparticularproblems.TheUniformCommercialCode,forexample,containssomespecialprovisionsontheformationofcontractsforthesaleofgoods.AndbytheTuckerActof1887,asamended,oneofthemostsignificantofthefe
7、deralstatutesinthefield,theUnitedStatesgovernmenthaswaiveditssovereignimmunityincontractactionsbyconsentingtosuitinthefederalcourts.Someruleslaiddownbystatute,andbycaselawaswell,aremandatoryorcompulsoryandcannotbeavoidedbytheparties,whileothersareimplicative,interp
