LawofthePeople'sRepublicofChinaonAnimalEpidemicPrevention(Adoptedatthe26thMeetingoftheStandingCommitteeoftheEighthNationalPeople'sCongressonJuly3,1997,promulgatedbyOrderNo.87ofthePresidentofthePeople'sRepublicofChinaonJuly3,1997)ContentsChapterIGeneralProvisionsChapterIIPreventionofAnimalEpidemicsChapterIIIControlandEliminationofAnimalEpidemicsChapterIVQuarantineofAnimalandAnimalProductsChapterVSupervisionoverAnimalEpidemicPreventionChapterVILegalResponsibilityChapterVIISupplementaryProvisionsChapterIGeneralProvisionsArticle1ThisLawisenactedwithaviewtostrengtheningadministrationofanimalepidemicprevention,preventing,controllingandeliminatinganimalepidemics,promotingdevelopmentofthebreedingindustryandprotectinghumanhealth.Article2ThisLawisapplicabletoallactivitiesconductedtopreventanimalepidemicswithintheterritoryofthePeople'sRepublicofChina.ThequarantineofentryandexitanimalsandanimalproductsshallbegovernedbytheLawofthePeople'sRepublicofChinaontheEntryandExitAnimalandPlantQuarantine.Article3"Animals"asusedinthisLawrefertolivestockandpoultryaswellasotheranimalsthatareartificiallyraisedorarelegallycaptured."Animalproducts"asusedinthisLawrefertoanimals'rawhides,rawhair,semen,embryos,fertilizedeggsaswellasunprocessedtrunks,fat,viscera,blood,wool,bones,horns,headsandhoofs."Animalepidemics"asusedinthisLawrefertoinfectiousanimaldiseasesandparasiticanimaldiseases.11 "Animalepidemicprevention"asusedinthislawcomprisestheprevention,controlandeliminationofanimalepidemicsaswellasthequarantineofanimalsandanimalproducts.Article4Slaughteringofanimalsshallbesubjecttoquarantineinspectionofthetrunks,heads,hoofsandvisceraofanimalsconductedandsupervisedinaccordancewiththisLaw.ThehygienicinspectionofandsupervisionoverthefoodsmadeoftheslaughteredanimalsthatarequarantinedasuptostandardsshallbeconductedinaccordancewiththeprovisionsoftheFoodHygieneLawofthePeople'sRepublicofChina.Article5TheStatepractisestheprincipleofputtingpreventionfirstwithregardtoanimalepidemics.Article6TheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncilshallbeinchargeofanimalepidemicpreventioninthewholecountry.Theadministrativedepartmentsforanimalhusbandryandveterinaryunderthelocalpeople'sgovernmentsatorabovethecountylevelshallbeinchargeofanimalepidemicpreventionintheirrespectiveadministrativeregions.Theinstitutionsforsupervisionoveranimalepidemicpreventionunderthepeople'sgovernmentsatorabovethecountylevelshalleffectanimalepidemicpreventionandexercisesupervisionoverit.Theinstitutionsforsupervisionoveranimalepidemicpreventioninthearmyshallbeinchargeoftheepidemicpreventionamongtheanimalsinactiveserviceandtheanimalsraisedbythearmyforitsownuse.Article7Thepeople'sgovernmentsatvariouslevelsshallstrengthentheirleadershipoveranimalepidemicprevention.Article8TheStateencouragesandsupportsscientificresearchinanimalepidemicprevention,promotesthewideuseofadvancedscientificresearchfindings,disseminatesscientificknowledgeaboutanimalepidemicprevention,andimprovesworkinthisfield.Article9Thepeople'sgovernmentsortheadministrativedepartmentsforanimalhusbandryandveterinaryshallawardtheunitsandindividualsthathaveachievedsuccessesormadecontributionsinanimalepidemicpreventionandinscientificresearchinthisfieldofendeavour.ChapterIIPreventionofAnimalEpidemicDiseasesArticle10Inlightoftheharmfulnessofanimalepidemicstoproductionofthebreedingindustryandtohumanhealth,theepidemicsundercontrolasprescribedbythisLawaregroupedintothefollowingthreecategories:(1)CategoryⅠincludesepidemicsthatmenacehumanbeingsandanimalssoseriouslythaturgent11 andseverecompulsorymeasuresmustbetakentoprevent,controlandeliminatethem;(2)CategoryⅡincludesepidemicsthatareliabletocauseheavyeconomiclossesandcallforstrictmeasurestocontrolandeliminatethem,andtopreventthemfromspreading;(3)CategoryⅢincludesepidemicsthatarecommonandfrequently-occurring,andareliabletocauseheavyeconomiclossesandneedtobecontrolledandforwhichsterilizationisnecessary.ThecataloguesofthespecificdiseasesunderthethreecategoriesofepidemicsmentionedaboveshallbeworkedoutandissuedbytheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil.Article11TheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncilshallformulatenationalplansforanimalepidemicprevention.TheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncilshall,inlightoftheanimalepidemicsituationsathomeandabroadandtheneedforprotectingproductionofthebreedingindustryandhumanhealth,drawupandannouncemeasuresforanimalepidemicpreventioningoodtime.TheStatepractisesaplannedimmunizationsystemwithregardtoanimalepidemicsthatseriouslyharmproductionofthebreedingindustryandhumanhealthandimplementscompulsoryimmunization.ThecataloguesoftheanimalepidemicsthataresubjecttocompulsoryimmunizationshallbeworkedoutandissuedbytheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil.Withregardtopreventionoftheanimalepidemicsthatarenotsubjecttocompulsoryimmunization,theadministrativedepartmentsforanimalhusbandryandveterinaryunderthelocalpeople'sgovernmentsatorabovethecountylevelshallformulateplansthereonandsubmitthemtothepeople'sgovernmentsatthesamelevelforapprovalbeforeimplementation.Article12TheStateshalltakemeasurestopreventandeliminateanimalepidemicsthatareseriouslyharmfultoproductionofthebreedingindustryandtohumanhealth.Thereshallbeappropriatereserveofthemedicines,biologicalproductsandrelevantmaterialsneededforpreventingandeliminatinganimalepidemics,whichshallbeincorporatedintotheplansfornationaleconomicandsocialdevelopment.Article13Theinstitutionsforsupervisionoveranimalepidemicpreventionshallimprovethepublicityandeducation,technicalguidanceandtraininginanimalepidemicpreventionandconsultancyservicetherefor,andseetoitthattheplansforimmunizationagainstanimalepidemicsarecarriedout.Animalepidemicpreventionorganizationsoftownships,nationalitytownshipsandtownsshall,undertheguidanceoftheinstitutionsforsupervisionoveranimalepidemicprevention,seetoitthatanimalepidemicsareeffectivelyprevented.Article14Unitsandindividualsthatraiseanddealinanimalsormanufactureanddealinanimal11 productsshall,inaccordancewiththeprovisionsofthisLawandrelevantStateregulations,immunizetheanimalsagainstepidemicsinaplannedwayandpreventsuchdiseaseseffectivelyandplacethemselvesunderthemonitoringandsupervisionoftheinstitutionsforsupervisionoveranimalepidemicprevention.Article15Animal-raisingfarmsshallwipeoutanimalepidemicswithoutdelay.BreedingstockandpoultrymustbeuptothehealthstandardssetbytheState.Article16Themeansoftransportandthebedding,paddingandpackagingmaterialsforanimalsandanimalproductsshallmeettherequirementsforanimalepidemicpreventionsetbytheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil.Epidemic-infectedanimalsandtheirexcrement,productsofepidemic-infectedanimals,andcarcassesofanimalsthatdiedofillnessorofuncertaincausesmustbehandledaccordingtotherelevantregulationsoftheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil,andmaynotbedisposedofatwill.Article17Animalpathogenicmicrobeshallbepreserved,utilized,andtransportedincompliancewiththeadministrationsystemandoperationproceduresprescribedbytheState.Wherepathologicalmaterialsofdisease-infectedanimalsareneededspeciallyforscientificresearch,teachingorepidemicprevention,theyshallbetransportedinaccordancewiththerelevantregulationsoftheState.Institutionsforscientificresearchofanimalepidemicsshall,inaccordancewiththerelevantStateregulations,exercisestrictcontroloverthelaboratoryanimalssoastopreventthespreadofanimalepidemics.Article18Itisforbiddentodealintheanimalsandproductsoftheanimalsasfollows:(1)thatarerelevanttotheanimalepidemicoccurringinablockadedepidemicarea;(2)thatarevulnerabletoinfectioninanepidemicarea;(3)thatfailtoundergoquarantineinspectionasisrequiredbylaworfailtopassthequarantineinspection;(4)thathavealreadycontractedtheepidemic;(5)thatdiedofillnessorofuncertaincauses;or(6)thatareunderothercircumstancesnotconformingtoregulationsoftheStateregardinganimalepidemicprevention.ChapterIIIControlandEliminationofAnimalEpidemics11 Article19TheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncilshallexerciseunifiedcontroloverandpubliclyannouncetheanimalepidemicsituationsthroughoutthecountry,andmayalso,whennecessary,authorizetheadministrativedepartmentsforanimalhusbandryandveterinaryunderthepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmenttopubliclyannouncetheanimalepidemicsituationsintheirrespectiveadministrativeregions.Article20Anyunitsorindividualsthatdiscoverorsuspectananimaltohavecontractedanepidemicshallimmediatelyreportthemattertothelocalinstitutionsforsupervisionoveranimalepidemicprevention.ThesaidinstitutionsshalltakepromptmeasuresandreportthemattertothehigherauthoritiesaccordingtorelevantStateregulations.Nounitsorindividualsmayconcealareportormakeafalsereportaboutorpreventanotherunitorpersonfromreportingontheepidemicsituations.Article21WhenananimalepidemicofCategoryⅠoccurs,theadministrativedepartmentforanimalhusbandryandveterinaryunderthelocalpeople'sgovernmentatorabovethecountylevelshallpromptlydispatchpeopletothescenetodemarcatetheepidemicplace,epidemicareaandvulnerablearea,andtocollectpathologicalmaterialsofdisease-infectedanimals,findoutthesourceoftheepidemic,andimmediatelyreporttothepeople'sgovernmentatthesamelevel,requestingittodecideonblockadingtheepidemicarea,andreport,levelbylevel,theepidemicsituationstotheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil.Thelocalpeople'sgovernmentatorabovethecountylevelshallpromptlyaskthedepartmentsandunitsconcernedtotakecompulsorymeasuressuchasisolating,catchingandkilling,exterminating,sterilizingorgivingemergencyimmunizationtothedisease-infectedanimalssoastoswiftlykeeptheepidemicundercontrolandwipeitout,andinformtheneighboringregionsofthematter.Duringtheperiodofblockade,anyoutflowofanimalsorproductsofanimalsthathavecontractedorthataresuspectedtohavecontractedtheepidemicfromtheepidemicareaisprohibited,andtheinflowofanimalsfromotherareasintotheepidemicareaisalsoprohibited,andsterilizationandotherrestrictivemeasuresshall,inlightoftheneedforeliminatingtheanimalepidemic,alsobetakenforpersons,meansoftransportandothergoodsenteringorleavingtheblockadedarea.Ifanepidemicareacoverstwoormoreadministrativeregions,thecommonpeople'sgovernmentatthenexthigherleveloftheseadministrativeregionsshallmakeadecisiononblockadingtheepidemicarea,orsuchadecisionshallbemadejointlybythepeople'sgovernmentsatthenexthigherleveloftheserespectiveadministrativeregions.Article22WhenananimalepidemicofCategoryⅡoccurs,theadministrativedepartmentforanimalhusbandryandveterinaryunderthelocalpeople'sgovernmentatorabovethecountylevelshalldemarcatetheepidemicplace,epidemicareaandvulnerablearea.Thelocalpeople'sgovernmentatorabovethecountylevelshall,wherenecessary,askthedepartmentsandunitsconcernedtotakesuchmeasuresasisolating,catchingandkilling,exterminating,sterilizingorgivingemergencyimmunizationtothedisease-infectedanimalsandrestrictionsonthe11 outflowandinflowofanimals,animalproductsandgoodsthataresusceptibletodiseasessoastokeeptheepidemicdiseaseundercontrolandwipeitout.Article23Theterminationofademarcatedepidemicplace,epidemicareaandvulnerableareaaswellastheterminationoftheblockadeofanepidemicareashallbeannouncedbytheauthoritiesthatoriginallymadethedecisiononthedemarcationandtheblockade.Article24WhenananimalepidemicofCategoryⅢoccurs,thepeople'sgovernmentsatthecountyandtownshiplevelsshall,inaccordancewiththeplansforanimalepidemicpreventionandtherelevantregulationsoftheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil,organizepeopletotreatitandsterilizetheepidemicareas.Article25IncaseananimalepidemicCategoryⅡorCategoryⅢbreaksoutandspreads,itshallbedealtwithinaccordancewiththeprovisionsofArticle21ofthisLaw.Article26Forthepurposeofcontrollingandeliminatingamajoranimalepidemic,theinstitutionforsupervisionoveranimalepidemicpreventionmaysendpeopletojointheexistinglocalcheckpointslegallysetuptocarryoutthetasksofsupervisionandcheckup.Provisionalcheckpointsforanimalepidemicpreventionandsupervision,whenevernecessary,maybesetuptocarryoutthetasksofsupervisionandcheckupuponapprovalofthepeople'sgovernmentofaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment.Article27Whenanepidemicoccursamongbothhumanbeingsandanimals,theadministrativedepartmentforanimalhusbandryandveterinaryconcernedshallexchangeinformationontheepidemicsituationswiththeadministrativedepartmentofpublichealthandrelevantunits.Thesedepartmentsandunitsshalltakepromptmeasurestokeeptheepidemicundercontrolandwipeitout.Article28Therelevantunitsandindividualsinanepidemicareashallcomplywiththeregulationsforcontrollingandeliminatingtheanimalepidemicformulatedaccordingtolawbythepeople'sgovernmentatorabovethecountylevelanditsadministrativedepartmentforanimalhusbandryandveterinary.Article29Whenananimalepidemicoccurs,thetransportationdepartments,includingdepartmentsofcivilaviation,railways,highwaysandwaterways,shallgiveprioritytotransportingthepeoplewhoaresenttocontrolandeliminatetheepidemicandthematerialsforthepurpose,andthetelecommunicationsdepartmentsshalltransmitreportsontheepidemicsituationswithoutdelay.ChapterIVQuarantineofAnimalsandAnimalProductsArticle30Theinstitutionsforsupervisionoveranimalepidemicpreventionshall,pursuanttothenationalstandardsandthetradestandards,themeasuresforquarantineadministrationandtheobjectsofquarantineasprescribedbytheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil,carryoutquarantineinspectiononanimalsandanimalproductsaccordingtolaw.Article31Theinstitutionsforsupervisionoveranimalepidemicpreventionshallbemannedwith11 quarantineofficerstocarryoutquarantineinspectiononanimalsandanimalproducts.Suchofficersshallhavethespecializedskillnecessaryforthejob,theirspecificqualificationsandthemeasuresforissuingqualificationcertificatesshallbestipulatedbytheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil.Theadministrativedepartmentsforanimalhusbandryandveterinaryunderthepeople'sgovernmentsatorabovethecountylevelshallimprovetrainingandappraisalofanimalquarantineofficersaswellastheadministrationoftheiraffairs.Animalquarantineofficersmaytakeupthejobandperformquarantineonlyaftertheyhaveobtainedthenecessaryqualificationcertificates.Animalquarantineofficersshallperformquarantineaccordingtotherulesofquarantineandberesponsiblefortheresultsthereof.Article32TheStatemakesitarulethatsuchanimalsaspigsareslaughteredatdesignatedplacesandthattheyundergounifiedquarantineinspection.Thepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshalldecideonthetypesofanimalstobeslaughteredatdesignatedplacesandtoundergounifiedquarantineinspectionandtheareasforthepurposeintheirrespectiveadministrativeregions;thespecificslaughterhouses(places)shallbedeterminedbythepeople'sgovernmentsofcities(includingthosenotdividedintodistricts)andcountiesthroughconsultationwiththedepartmentsconcerned.Theinstitutionsforsupervisionoveranimalepidemicpreventionshallcarryoutquarantineinspectionontheanimalsslaughteredatslaughterhouses(places)andaffixtothemtheuniformsealofquarantineinspectionasisusedbyallsuchinstitutions.Theslaughterquarantineattheslaughterhousesandintegratedmeat-packingplantsasdecidedthroughconsultationbytheadministrativedepartmentforanimalhusbandryandveterinaryandtheadministrativedepartmentforcommoditycirculationundertheStateCouncilshallbeconductedaccordingtotherelevantregulationsoftheStateCouncil,anditshallbesubjecttosupervisionaccordingtolaw.Article33Measuresforadministrationofquarantineofsuchanimalsaspigsslaughteredbyindividualfarmersfortheirownuseshallbedrawnupbythepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment.Article34Theinstitutionsforsupervisionoveranimalepidemicprevention,whenperformingquarantineaccordingtolaw,shallcollectaquarantinefeeaccordingtotheregulationssetbytheadministrativedepartmentsoffinanceandpricecontrolundertheStateCouncil.Theymaynotimposeanyextracharges,neithermaytheycollectthesamefeeasecondtime.Article35Theinstitutionsforsupervisionoveranimalepidemicpreventionmaynotengageinanyprofit-makingactivities.Article36Thebreedinganimals,theirsemen,embryosandfertilizedeggstobeintroducedfromanotherplaceofthecountryshallbesubjecttoformalitiesforpriorexaminationandapproval,inrespectofquarantine,bythelocalinstitutionforsupervisionoveranimalepidemicpreventionandmustpassquarantineinspection.11 Article37Capturedwildanimalsthatmightspreadanimalepidemicsmustundergoandpassthequarantineinspectionconductedbytheinstitutionforsupervisionoveranimalepidemicpreventionattheplaceoftheircaptureortheplaceofacceptancebeforetheyaresoldortransported.Article38Theinstitutionsforsupervisionoveranimalepidemicpreventionshallissuequarantinecertificatesforanimalsandanimalproductsthathavepassedquarantineinspectionandshall,inaddition,placethequarantineinspectionmarksorsealingswhichareusedbysuchinstitutionsonsuchanimalproducts.Animalsoranimalproductsthatfailtopassquarantineinspectionshallbesubjectedtoanti-epidemicsterilizationorotherinnocenttreatmentbytheownersthereofunderthesupervisionofanimalquarantineofficers.Thosethatcannotundergoinnocenttreatmentshallbeexterminated.Article39Animalsmaybesoldortransportedandmayparticipateinexhibitions,performancesandcompetitionsonthestrengthofquarantinecertificates.Animalproductsmaybesoldortransportedonthestrengthofquarantinecertificatesandquarantineinspectionmarksorsealings.Article40Quarantinecertificatesmaynotbetransferred,alteredorforged.TheformofthequarantinecertificatesandthemeasuresforcontrolofsuchcertificatesshallbedrawnupbytheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncilChapterVSupervisionoverAnimalEpidemicPreventionArticle41Theinstitutionsforsupervisionoveranimalepidemicpreventionshallexercisesupervisionoveranimalepidemicpreventionaccordingtolaw.Whenperformingtheirtasksofmonitoringandsupervision,theinstitutionsforsupervisionoveranimalepidemicpreventionmaytakesamplesfromanimalsandanimalproducts,keepthemforfurtherquarantineinspectionorconductrandominspection;conductorrepeatquarantineinspectiononanimalsandanimalproductsforwhichnoquarantinecertificateshavebeenobtained;isolateanddisposeoftheanimalsthathavecontractedtheepidemicorthataresuspectedtohavecontractedtheepidemicandsealupanddisposeoftheproductsofanimalsthathavecontractedtheepidemic.Article42Beforehavingtheanimalsandanimalproductstransportedbyrail,highway,waterway,orair,theconsignorsmustproducequarantinecertificates;thecarriersmayonlyacceptforcarriageagainstthequarantinecertificates.Theinstitutionsforsupervisionoveranimalepidemicpreventionshallhavethepowertosuperviseandcheckthetransportationofanimalsandanimalproductsaccordingtolaw.Article43Whenperformingtheirtasksofsupervisionandinspection,thesupervisorsofanimalepidemicpreventionshallpresenttheirpapers,andtheunitsandtheindividualsconcernedshallassistandcooperatewiththem.11 Whenconductingsupervisionandinspectionofanimalepidemicprevention,theinstitutionsforsupervisionoveranimalepidemicpreventionandtheirofficersmaynotchargefees.Article44Thesitesofanimal-raisingfarms,storagehouses,slaughterhouses,integratedmeat-packingplants,otherdesignatedslaughterhouses(places)andcoldstoragehousesofanimalproductsshallbeselectedanddesignedinconformitywiththerequirementsforanimalepidemicpreventionlaiddownbytheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil.Article45Animal-raisingfarms,slaughterhouses,integratedmeat-packingplantsandotherdesignatedslaughterhouses(places)shallraiseanddealinanimalsormanufactureanddealinanimalproductsinconformitywiththerequirementsforanimalepidemicpreventionlaiddownbytheadministrativedepartmentforanimalhusbandryandveterinaryundertheStateCouncil,andplacethemselvesunderthesupervisionandinspectionbytheinstitutionsforsupervisionoveranimalepidemicprevention.Institutionsthatareengagedinveterinaryactivitiesshallhavespecializedtechniciansqualifiedfortheworkandobtainveterinarypermitsissuedbytheadministrativedepartmentsforanimalhusbandryandveterinary.Personssufferingfromaninfectiousdiseasewhichmaybecontractedbybothhumanbeingsandanimalsmayneitherdirectlymakediagnosisforortreatanimals,norraiseordealinanimals,normanufactureordealinanimalproducts.ChapterVILegalResponsibilityArticle46Whoever,inviolationoftheprovisionsofthisLaw,commitsanyofthefollowingactsshallbegivenanadministrativewarningbytheinstitutionforsupervisionoveranimalepidemicprevention;ifherefusestosetitright,thesaidinstitutionitselfshallhandlethecaseaccordingtolawandallthecostthusincurredshallbebornebytheoffender:(1)failingtocarryouttimelyimmunizationandsterilizationwithregardtotheanimalsheraisesordealsin,accordingtotheplanofcompulsoryimmunizationagainstanimalepidemicsandrelevantStateregulations;(2)failingtocleanandsterilize,accordingtorelevantStateregulations,themeansoftransport,bedding,paddingandpackagingmaterialsforanimalsandanimalproducts;or(3)failingtodisposeof,accordingtorelevantStateregulations,epidemic-infectedanimalsandtheirexcrement,productsofepidemic-infectedanimals,orcarcassesofanimalsthatdiedofillnessorofuncertaincauses.Article47Whoever,inviolationoftheprovisionsofArticle17ofthisLaw,preserves,utilizesortransportsanimalpathogenicmicrobeortransportspathologicalmaterialsofdisease-infectedanimals11 shallbegivenanadministrativewarningbytheinstitutionforsupervisionoveranimalepidemicpreventionandmayalsobefinednotmorethan2,000yuan.Article48Whoever,inviolationoftheprovisionsofthisLaw,dealsinthefollowinganimalsoranimalproductsshallbeorderedbytheinstitutionforsupervisionoveranimalepidemicpreventiontostopdoingso,whichshalltakepromptmeasurestorecovertheanimalsandanimalproductsalreadysoldoutandconfiscatetheillegalgainsandtheanimalsandanimalproductsnotyetsold.Ifthecircumstancesareserious,hemayalsobefinednotmorethanfivetimestheillegalgains:(1)thatarerelevanttotheanimalepidemicoccurringinablockadedepidemicarea;(2)thatarevulnerabletoinfectioninanepidemicarea;(3)thatfailtopassquarantineinspectionalthoughtheyhaveundergoneitaccordingtolaw;(4)thathavealreadycontractedtheepidemic(5)thatdiedofillnessorofuncertaincauses;or(6)thatareunderothercircumstancesnotconformingtoregulationsoftheStateregardinganimalepidemicprevention.Article49Whoever,inviolationoftheprovisionsofthisLaw,dealsinanimalsoranimalproductsthataresubjecttoquarantineinspectionaccordingtolawbutfailtoobtainanyquarantinecertificateshallbeorderedbytheinstitutionforsupervisionoveranimalepidemicpreventiontostopdealinginthem,whichshallconfiscatetheillegalgains;theanimalsandtheanimalproductsnotyetsoldshallbesubjectedtoquarantineinspectionaccordingtolawanddealtwithinaccordancewiththeprovisionsofArticle38ofthisLaw.Article50Whoever,inviolationoftheprovisionsofArticle42ofthisLaw,failstoimplementtheprovisionsontransportinganimalsandanimalproductsbyvirtueofquarantinecertificatesshallbegivenanadministrativewarningandorderedtosetitrightbytheinstitutionforsupervisionoveranimalepidemicprevention;ifthecircumstancesareserious,theconsignorandthecarriermayeachbefinednotmorethanthreetimesthefreight.Article51Ifapersontransfers,altersorforgesaquarantinecertificate,hisillegalgainsshallbeconfiscatedbytheinstitutionforsupervisionoveranimalepidemicpreventionandthequarantinecertificateseized.Ifapersontransfersoraltersaquarantinecertificate,heshall,inaddition,befinednotlessthan2,000yuanbutnotmorethan5,000yuan,wheretheamountofhisillegalgainsexceeds5,000yuan,heshallbefinednotlessthanonetimebutnotmorethanthreetimestheamountofhisillegalgains.Ifapersonforgesaquarantinecertificate,heshall,inaddition,befinednotlessthan10,000yuanbutnotmorethan30,000yuan,wheretheamountofhisillegalgainsexceeds30,000yuan,heshallbefinednotlessthanonetimebutnotmorethanthreetimestheamountofhisillegalgains.Ifacrimeisconstituted,thepersonshallbeinvestigatedforcriminalresponsibilityaccordingtolaw.Article52Ifaunitthatraisesanddealsinanimalsormanufacturesanddealsinanimalproducts,inviolationoftheprovisionsofparagraph1ofArticle45ofthisLaw,failstomeettherequirementsfor11 animalepidemicprevention,itshallbegivenanadministrativewarningandorderedtomakeamendsbytheinstitutionforsupervisionoveranimalepidemicprevention.Ifitrefusestodoso,itshall,inaddition,befinednotlessthan10,000yuanbutnotmorethan30,000yuan.Article53Anyunitthat,inviolationoftheprovisionsofthisLaw,concealsareportormakesafalsereportonanimalepidemicsituationsorobstructsanotherunitorpersonfromreportingonsuchsituations,shallbegivenanadministrativewarningbytheinstitutionforsupervisionoveranimalepidemicpreventionandbefinednotlessthan2,000yuanbutnotmorethan5,000yuan;thepersonswhoaredirectlyinchargeandtheotherpersonswhoaredirectlyresponsiblefortheviolationshallbegivenadministrativesanctionsaccordingtolaw.Article54Whoever,inviolationoftheprovisionsofthisLaw,evadesquarantineinspection,thusresultingintheoccurrenceofamajoranimalepidemicandconsequentlycausingheavylossestoproductionofthebreedingindustryandseriouslyharminghumanhealth,shallbeinvestigatedforcriminalresponsibilityaccordingtolaw.Article55Ifaquarantineofficer,inviolationoftheprovisionsofthisLaw,issuesquarantinecertificatesfororaffixquarantinesealsonanimalsoranimalproductsthathavenotundergonequarantineinspectionorfailtopassthequarantineinspection,heshallbegivenademeritorhisqualificationsasaquarantineofficerberevokedbyhisworkunitorbythecompetenthigherauthorities.Ifthecircumstancesareserious,heshallbeexpelledfromtheunit.Iftheviolationasmentionedintheprecedingparagraphcausesharmtothepartiesconcerned,theunittowhichthequarantineofficerbelongsshallbeliableforcompensation.Article56Ifamemberoftheinstitutionforsupervisionoveranimalepidemicpreventionabuseshispower,neglectshisduty,commitsirregularityforthebenefitofhisrelativesorfriends,concealsareportordelaysreportingonepidemicsituations,orfalsifiesaresultofquarantineinspection,wherehisactconstitutesacrime,heshallbeinvestigatedforcriminalresponsibilityaccordingtolaw;ifthecircumstancesarenotseriousenoughtoconstituteacrime,heshallbegivenadministrativesanctionsaccordingtolaw.Article57Whoeverobstructsamemberoftheinstitutionforsupervisionoveranimalepidemicpreventionfromperforminghisdutyaccordingtolaw,ifacrimeisconstituted,shallbeinvestigatedforcriminalresponsibilityaccordingtolaw;ifthecircumstancesarenotseriousenoughtoconstituteacrime,heshallbepunishedinaccordancewiththeregulationsonadministrativepenaltiesforpublicsecurity.ChapterVIISupplementaryProvisionsArticle58ThisLawshallgointoeffectasofJanuary1,1998.11
