1、华中科技大学硕士学位论文摘要现代社会，人口膨胀，城市化进程加剧，地表资源的有限性使得人类迫切需要对空间进行开发利用，空间权法律制度随之在一些国家和地区相继建立，空间权理论也为大多数国家立法和判例所确认。对空间权进行可持续发展和法经济学研究，有利于人类充分、有效及永续利用土地资源。相对而言，我国在空间利用实践上已走在世界前列，然而相应的空间权立法与学术研究却还十分落后，对其进行方法论的创新研究就更为薄弱。因此，我国有必要以可持续发展和法经济学的新理念加强空间权的理论研究，并建立具有中国特色的空间权法

2、律制度。本文共分为四个部分。文章第一部分主要是简单介绍了空间权的一些基本理论问题，空间权的基本理论研究，是构建空间权法律制度的前提；文章的第二部分则对两大法系主要国家空间权的立法模式进行了比较分析，并且作了简要评析，从中发现他们的异同之处，并为我国在借鉴时打好基础；文章的第三部分则主要是针对我国空间权理论研究方法的不足进行方法论的创新，试图在空间权法律制度研究中引入可持续发展观和法律的经济分析方法，以求空间权研究的新发展；文章的最后一部分主要是在前文论述的基础上，指出在我国建立空间权法律制度的重要意
