1、南京航空航天大学硕士学位论文摘要世界发达国家现代化城市建设的实践表明，开发利用城市地下空间资源，不但可以缓解城市发展与土地稀缺之间的矛盾，而且为城市的现代化提供了新的发展空间。随着我国城市化进程的加速，人们也兴起了对地下空间开发利用的热潮。但是由于缺乏有关地下空间开发利用的法律规范，针对地下空间开发利用而产生的一系列权利义务关系，得不到有效的规制。因此，探讨地下空间权的理论问题，论述以法律调整地下空间权法律关系的合理性以及必要性，对地下空间权的相关立法既富有理论指导意义，又颇具有实践价值。本文的绪论部分主要介绍了，作者选题的原因、目的和意义，然后概

2、括了本课题的相关研究现状，并重点分析了存在的问题，为研究的具体方向和研究范围指明了道路，最后对作者采用的具体研究方法进行了说明。正文部分，由四个章节组成。首先在地下空间权的界定中，对地下空间权的基本概念和特征予以解释，并分析说明了，地下空间权产生的理论和实践原因，同时对地下空间权的体系进行了概述；而后在地下空间权概念界定的基础上，分别对所有权和使用权的相关理论问题进行了详细的阐述；上述理论问题的分析结束以后，作者便尝试把之前的研究成果，运用到解决我国地下空间权的立法实践问题中，为完善我国的相关立法工作提供作者的研究建议，即地下空间权相关立法的完善这一
