1、摘要中国传统法律思想是世界法律文化史上的一颗耀眼的明珠，具有不可动摇的重要地位。中国传统法律思想涉猎广泛，内容丰富。“慎刑”思想是中国传统法律思想中独具特色的重要因素，它不仅仅表现在思想层面，同样也表现在制度层面。慎刑”问题在中国古代的立法和司法体系中占有显赫而尊崇的地位，备受历代统治者的重视。通过对这一思想的发展演变的论述有助于加深对中国传统法律思想的认识和了解。本文主要分为三章。第一章论述了清代“慎刑”在制度方面的体现，包括在立法、司法、执法方面的具体体现；第二章从思想方面论述了清代慎刑的发展以及影响清代慎刑的背景因素，通过与以往朝代的比较分析探求清代“慎刑”的思想根源

2、，通过论述影响清代“慎刑”的背景因素分析“慎刑”在清代的特点；第三章论述了清代“慎刑”的实践意义及其局限性，并从我国现行刑法中“慎刑”的体现入手探求清代“慎刑”对我国现行刑法的借鉴意义。本文的第一个创新点是不仅从思想方面论述了慎刑的发展，也从立法、司法等宏观的制度表现方面分析了清代的“慎刑”。本文的第二个创新点是对影响慎刑受到不同态度以及其自身不同的表现形式的各种因素进行深入分析。慎刑是古代和谐观念的体现，对清代慎刑思想以及制度方面的研究有助于加深对中国传统法律文化的认识和了解，另外对中国现行刑事立法、司法的发展具有重要的意义，可为今天构建和谐社会提供借鉴。关键词：清代；慎
