2、行为中的信赖保护与众不同的意义。本文第一部分首先就我国现在的行政合同发展中存在的问题进行了剖析，阐述了在行政合同中确立信赖保护原则对于保护相对人利益、重建政府信用的必要性，从而说明为什么要在行政合同中研究信赖保护问题。第二部分是行政合同中信赖保护的专门讨论，细致地分析了信赖保护在行政合同中的具体构成，以及在行政合同中进行信赖保护的理论、现实和规范依据，解读行政合同中的信赖保护有哪些特殊之处。第三部分，比较两大法系对信赖利益的不同保护方式。由于中国目前尚无专门的行政合同立法，相对来说国外的行政法治要更为完善一些，通过对

3、两大法系各自代表国家的比较，可以为我国建立自己的保护方法提供借鉴和经验。第四部分，提出对完善我国行政合同中信赖利益保护的思考。笔者认为，首先应当完善行政合同的相关立法，将信赖保护引入法制化的轨道。其次，借鉴域外立法中的信赖保护方式，尤其加强对期待利益的保护。最后，主张将行政合同纠纷正式纳入行政诉讼受案范围，用行政救济对信赖利益进行有针对性的保护。关键词：行政合同；信赖利益保护；期待利益AbstractAsakindofadministrativeactions,theadministrativecontracthas
