1、论劳动合同法的立法依据和法律定位论劳动合同法的立法依据和法律定位常凯中国人民大学ChinaRenmingUniversity【摘要】劳动合同制度实施中存在的无合同、合同短期化、不规范等问题，严重地侵害了劳动者的权益，影响了劳动关系的和谐。这种劳动关系的现状特别是劳动合同制度实施过程中存在的问题，是劳动合同立法的现实依据。劳动合同立法的的理论依据，则在于劳动合同法律所规制的劳动合同关系，是一种具有从属性质的个别劳动关系，劳动合同也是一种从属性的合同。这是一种不对等和不平衡的关系。劳动合同立法的基本目的是为了实现劳资双方的力量相对平衡，以实现劳动合同关系长期化和稳定化。为此，《劳动合同法》的

2、基本定位应该坚持以下原则：以劳动者保护为基本宗旨的《劳动法》应是劳动合同立法的基本的法律依据；劳动合同立法的主旨和出发点是保护劳动者；劳动合同立法的社会功能是追求社会公平，实现劳资两利；对于劳动关系的调整必须强调公权力的介入。【关键词】劳动合同法；劳动关系；劳动合同；立法OntheLegislativeBasisandLegalOrientationofLabourContractLaw【英文摘要】ThisarticlehasanalysedtheLabourContractLawintermsofitslegislativebasisandlegalorientation．Arguab
