1、论劳动合同法的立法依据和法律定位常凯中国人民大学ChinaRenmingUniversity【摘要】劳动合同制度实施中存在的无合同、合同短期化、不规范等问题，严重地侵害了劳动者的权益，影响了劳动关系的和谐。这种劳动关系的现状特别是劳动合同制度实施过程中存在的问题，是劳动合同立法的现实依据。劳动合同立法的的理论依据，则在于劳动合同法律所规制的劳动合同关系，是一种具有从属性质的个别劳动关系，劳动合同也是一种从属性的合同。这是一种不对等和不平衡的关系。劳动合同立法的基本目的是为了实现劳资双方的力量相对平衡，以实现劳动合同关系长期化和稳定化。为此，《劳动合同法》的基本定位应
