1、现状·困境与出路——平安重庆视野下多元化纠纷解决机制的表达及实践重庆市第三中级人民法院李健[内容提要]当前，随着社会的发展，社会矛盾与纠纷呈增多与叠加之势，在此形势下提出构建多元化纠纷解决机制对于快速解决纠纷，化解矛盾，从而建设社会主义和谐社会具有重要价值。从中央到地方，努力建立多元化纠纷解决机制已成共识。中共重庆市委、重庆市人民政府也于2008年联合出台了构建多元化纠纷解决机制的意见。但是，由于多元化纠纷解决机制并不简单等同于被称之为“东方经验”的调解制度，也因国情不同而无法完全照搬国外的替代性纠纷解决机制（ADR），加之理论准备不足和缺乏实践经
