2、程序等都存在不少缺陷。不管是从程序正义理论、保障司法公正与人权的目的，还是从实现诉讼效率、弥补我国刑事搜查制度现实缺陷，我国刑事搜查制度都有完善之必要。通过对英、美、法、德等国有关刑事搜查制度的立法规定考察，可以看出我国与西方发达国家在刑事搜查领域还存在不少的差距，其明确搜查理由的做法和搜查决定权与执行权分离的立法设计都值得我国借鉴与吸收。立法完善我国刑事搜查制度的构想具体包括以下几个方面：构建刑事搜查的司法审查制度；明确刑事搜查启动理由；细化搜查证内容；重构无证搜查类型与标准；完善刑事搜查的司法救济制度等。关键词：刑事搜查；诉讼价值；司法审查；启动理由AB
