3、rement,thusrequiringtheabsentpersontobejoined.Abasicprincipleofresjudicata,however,isthatanabsentpersonwillonlybeboundifheisinprivitywithaparty.'Privityexistsbetweenapartyandanabsentpersonifthatpartyadequatelyrepresents,andthereforeprotects,theabsentperson'sinterests.Thus,bydefini
4、tion,beingboundbyresjudicatameansanabsentperson'sinterestswereprotectedandhisabilitytoprotecthisinterestswasnotimpaired.Itisillogicalfoi-courtstorequireaperson'sjoinderbysayingthathewillbeboundbyresjudicatabecausetherelevantportionofRule19onlyrequiresjoinderwhenanabsentperson'sabi
5、litytoprotecthisinterestsisimpaired.Despitetheclearlogicalinconsistencyinusingresjudicataas¡abasisforjoinder,thecircuitcourtsaresplitontheissue.Asecondjustificationfortheuseofresjudicataasabasisforjoindermightbethattheexpandingbreadthofresjudicata'hasmadecourtswaryofafuturecourtin
6、vokingthedoctrineagainsttheabsentpersoninquestion.Underthisjustification,thecourtwilldeemanabsentpersonnecessaryifthereisachancealatercourtwillbindhimtothejudgmentinthe¡presentcase.Althoughthisjustificationcarriesmoreweightthanthefirst,itisstillproblematic.Theproblemboilsdowntothe
