2、政府作为代理人为其管理运行住房公积金。但由于缺乏约束机制、信息不对称引起道德风险，使住房公积金的委托人的权益没有受到很好的维护。2002年修改的《住房公积金管理条例》(以下简称《条例》)中已经明确规定了住房公积金的所有权归个人所有，而且住房公积金是专款专用，也不能拿来进行买卖、转让等，所以这里所说的权益未受到完全保护，主要指的是公积金的使用权与收益权。本文主要使用了委托代理理论和产权理论对这两个权益进行分析研究。首先对住房公积金的产权理论进行全面的分析，理解产权理论和委托代理理论，全面分析在现行制度下住房公积金的产权归属情况(

3、包括归属权、处置权、占有权、收益权以及使用权)以及住房公积金的委托代理制度，指出住房公积金收益权和使用权缺乏保护的问题。其次在委托代理理论和产权理论的基础上，结合对长沙市的调查情况，对两个权益进行分析研究。最后提出相应的对策建议，保护公积金的委托人兼受益人兼缴交者的权益，为住房公积金制度的更加完善提出参考性建议。关键词：住房公积金，使用权，收益权ABSTRACTOurcountryhasestablishedthehousingprovidentfundsystemforovertwentyyears，whichinoneha
