1、摘要近年来，我国因房屋拆迁带来的社会问题逐渐突显，暴力强拆、极端对抗、祈拆致富的案例常常成为各媒体的头版焦点，人们越来越感觉到：随着我国住房制度改革和国有土地使用制度改革的深入，城市房屋拆迁中的财产权关系日益复杂，市场因素的影响越来越重大，原有以《城市房屋拆迁管理条例》(2001年修改颁布，以下简称《拆迁管理条例》)为直接依据的城市房屋拆迁制度构架已不能再适应市场经济发展的形势要求，而致使城市房屋拆迁行为逐渐陷入混乱无序的状态。在这样的大背景之下，以2009年底北京大学五位著名学者向全国人大常委会递交《关于对<城市房屋拆迁

2、管理条例>进行审查的建议》，建议立法机关对该条例进行审查，撤销这一条例或由全国人大专门委员会向国务院提出书面审查意见，建议国务院对《拆迁管理条例》进行修改为契机，从2010年初起，国务院法制办经过两次对社会各界公开征求意见及审议修改，终于在2011年1月21日，《国有土地上房屋征收与补偿条例》正式出台。J下是在这一历史背景之下，本文将以新出台的《国有土地上房屋征收与补偿条例》为主体，通过其与原有制度的对比，分析讨论新条例的改进之处及其背后的合法性依托，同时就新条例中备受争议的条款进行探讨并提出完善建议。以期通过洞悉理解现有
