就业服务与就业管理规定(英文版)劳动和社会保障部ReleaseoftheRegulationsonEmploymentServiceandEmploymentManagementbytheMinistryofLaborandSocialSecurityOrderoftheMinistryofLaborandSocialSecurity[2007]No.28November5,2007TheRegulationsonEmploymentServiceandEmploymentManagementhavealreadybeenpassedonthe21stMinisterialMeetingheldbytheMinistryofLaborandSocialSecurityon30October2007,andareherebypromulgated,andshallcomeintoforceasofJanuary1,2008.                                                                                                                     Minister:TianChengpingAttachment:RegulationsonEmploymentServiceandEmploymentManagementChapterIGeneralProvisionsArticle1TheseregulationsareformulatedinaccordancewiththeEmploymentPromotionLawaswellasotherlawsandadministrativeregulationssoastoimproveemploymentserviceandintensifyemploymentmanagementpractices,fosterupandconsummateanopen,well-structuredhumanresourcesmarketfeaturingcompetitionsinadueorder,andprovideservicesforjob-seekinglaborersandtalent-seekingemployingunits.Article2Theseregulationsshallapplytothelaborer'sjobapplicationandwork,theemployer'semploymentand,provisionofemploymentserviceactivitiesbypublicemploymentserviceorganssponsoredbylaborsecurityauthoritiesandemploymentintermediaryorgansexaminedandapprovedbylaborsecurityauthorities.TheemployingunitsmentionedinthisRegulationrefertoenterprises,individualeconomyorganizations,privatenon-enterpriseorganizations,state-ownedadministrations,institutionsandsocialorganswithinChineseterritorywhichrecruitlaborerswithwhomtheyenterintolaborrelations.Article3Laborsecurityadministrationsabove-countylevelshallprovideemploymentserviceandconductemploymentmanagementwithintheirrespectivelyadministrativeareaspursuanttolaws.ChapterIIJobApplicationandEmploymentArticle4Laborersshallenjoytherighttobeemployedonanequalbasisaccordingtolaws.Laborersshallbesubjecttonodiscriminationincurredbydiscrepanciesintermsofnationality,race,genderandregion.Article5Rurallaborersseekingemploymentinurbanareasshallenjoyanequalrightofemploymentasurbanlaborersdo.Itisnotallowedtoimposediscriminatoryrestrictionsuponrurallaborersseekingemploymentinurbanareas.Article6Anylaborershallenjoytherighttogetemployedontheirownpursuanttolaws.Thelaborerabovetheageof16withworkingability,desireforajob,andqualifiedforlegalrequirementaccordingtolaws,mayapplyforajobbywayofbeingintroducedbyjobcenters or directlycontactingemployerswithhisidentitydocumentsaswellaseducationandtrainingcertificates.Article7Whenseekingjobs,laborersshallfaithfullyprovidethepublicemploymentserviceorgans or employmentintermediaryorgans,andemployingunitswiththeirpersonalprofiles,descriptionsoftheirknowledgeandskills,workexperience,statusquoofemploymentdirectlyrelatingtothejobpoststheyareapplyingfor,andalsopresentcertificationsthereof. Article8Laborersshallsetupaproperconceptinchoosingtheirjobs,andenhancetheircareerskillsandabilitiesofstartingundertaking.Thecountryencourageslaborerstoreceivenecessarycareereducation or trainingpriortoemployment,andalsoencouragesgraduatesofjuniorandseniorhighschoolsofcitiesandtownstoreceivepreparatorytrainingspriortoemployment.Thecountryencourageslaborerstolaunchtheirownbusinessesandseekjobsontheirown.Laborsecuritydepartmentsatalllevelsshallworkwithcompetentdepartments,streamlineformalities,enhancetheirworkingefficiency,andprovideconvenienceandcorrespondingservicesforlaborers'launchoftheirownbusinessesandseekingofjobsontheirown.ChapterIIIEmploymentArticle9Theemployingunitshallenjoytherighttorecruitlaborersatitsowndiscretion.Eachemployingunitshallprovideequalemploymentopportunitiesandfairemploymentconditionsforalllaborers.Article10Employingunitsmayenrolllaborersontheirowninthefollowingways:1.Entrustingpublicemploymentserviceorgans or employmentintermediaryorgans;2.Participatinginjobfairs;3.Publishingadvertisementforemployersbyentrustingmassmediasuchasnewspapers,radiochannels,TVstationsandwebsites.4.Publishingjobapplicationinformationwithintheirownpremisesandontheirowncorporatewebsites;5.Otherlegitimatemeans.Article11Whenentrustingapublicemploymentserviceorgan or employmentintermediaryagencywiththeemploymentoflaborers or participatinginajobfair,theemployingunitshallpresentgeneralrulesofemployment,businesslicenseduplicate. or theofficialdocumentissuedbythecompetentauthorityinrespectofapprovalofitsestablishment,identitydocumentsofthestaffwhodealswithsuchbusinessandcertificateofauthorizationbytheemployingunit.Thegeneralrulesofemploymentshallcomprisebasicconditionsoftheemployer,numberofenrollment,typeofjob,requirementofpositionandqualificationforenrollment,remuneration,welfare,laborprotection,etc.,aswellasotherdetailsstipulatedunderlawsandlegislations.Article12Whenrecruitinglaborers,theemployingunitshallinformlaborersfaithfullyaccordingtolawsofjobtaskstobeperformed,workingconditions,jobsites,occupationalhazards,conditionsofsafetyinproduction,laborremunerationandotherdetailsthatlaborersshallbeinformedof.Theemployingunitshallnotifylaborersintimeofwhether or nottheyareemployed,attherequestoflaborers.Article13Theemployingunitshallkeepinsecrecythepersonaldataoflaborers.Anypublicityofpersonaldataoflaborersandanyuseoflaborers'techniquesandintellectualachievementsshallbeusedunderwrittenconsentoflaborers.Article14Theemployingunitshallnotcommitanyofthefollowingpracticeswhenrecruitinglaborers:1.Publishingfalseemploymentinformation,andreleasefalseemploymentadvertisement;2.Detainingresidentidentitycertificatecard or otherdocumentsoftheemployedpersons;3.Collectingpropertyfromthehiredpersonundernameofguaranty or anythingelse;4.Enrollingminorsunder16yearsoldandotherpersonswhoshallbenotemployedasstipulatedinthecountry'slawsandadministrativelaws;5.Enrollingpersonswithoutlegitimatecertificates;6.Seekingunlawfulprofits or conducingotherillegalactivitiesinthenameofrecruiting. Article15Theemployingunitshallnotenrolllaborersbyunfairmeanssuchasslanderingotheremployingunits'reputation or committingcommercialbribery.Article16Whenenrollinglaborers,theemployingunitshallnoteitherrefusetorecruitwomen or setdownhigherqualificationstandardsonfemaleapplicantsthanthoseonmaleapplicantsforanyreasoninrespectofgender,exceptforrecruitingcandidatesforanytypesofwork or jobpostswhereitisinappropriatetorecruitwomen.Whenenrollingfemalelaborersandstaffmembers,employingunitshallnotstipulateanyrestrictionsontheirmarriage or childbirthinthelaborcontractstobesignedwiththem.Article17Theemployingunitshallgrantpreferentialtreatmentstolaborersofnationalminoritiestoanappropriateextent,accordingtolaws.Article18Whenemployingpersonnel,theemployingunitshallnotdiscriminatedisabledpeople.Article19Theemployingunitrecruitingpersonnelshallnotrefusetoemployanycandidateonthegroundthatthecandidateisacarrierofsomeinfectiouspathogen.However,anypersonwhoisfoundtobeacarrierofinfectiouspathogenasverifiedbymedicalexpertiseshallnottakeupanyworkwhereitiseasytocauseanyinfectiousdiseasetoinflictmorepeopleasstipulatedunderlaws,administrativelawsandbythecompetentpublichealthorganoftheStateCouncil,beforebeingcured or excludedfromthelistofsuspects.Inrecruitingpersonnel,theemployingunitmayprohibitcarriersofhepatitisBpathogenfromtakingupcertaintypesofworkasstipulatedunderthecountry'slaws,administrativedecreesandregulationsofthehealthauthorityoftheStateCouncil,andshallnottakethehepatitisBvirusserologicalindicatorasoneofthecriteriaofphysicalcheckup.Article20Thegeneralrules or advertisementofemploymentmadepublicbytheemployingunitshallnotcontainanydiscriminatoryinformation.Article21Whenrecruitinglaborerstobeengagedinanyspecialtypeofworkwithregardtopublicsafety,humanhealth,humanlifeandsafetyofproperties,etc.,theemployingunitmustrecruitthosecandidateswhohaveheldcertificatesofcorrespondingqualification.Anyemployingunitthathasrecruitedanylaborerswhohavenotheldsuchcertificatesofqualificationforsomecertaintypeofworkyetshallorganizesuchlaborerstoreceivespecific-purposetrainingsbeforecommencingtheirwork,soastoensurethemtoobtaincertificatesofoccupationalqualificationbeforecommencingtheirwork.Article22AfterhiringemployeesfromTaiwan,HongKongandMacao,theemployingunitshallfilesuchemployeeswiththelocallaborsecurityadministrationaccordingtorelevantregulations,andalsoapplyforTaiwan,HongKong,andMacauExpatriatesEmploymentCertificateonbehalfofthem.Article23Whenrecruitingforeigners,theemployingunitshall,priortotheseforeigners'arrivalinChina,applyforemploymentpermitsforthemfromthelocallaborsecurityauthorityinaccordancewithrelevantregulations,andshallnotrecruitforeignersuntilhavingbeenapprovedtodosoandalsoobtainedthePermitsforEmploymentofForeignersinthePeople'sRepublicofChina.Thosejobpoststowhichforeignerscanberecruitedbytheemployingunitmustbethosewherespecialskillsandrequirementshavetobedelivered or met,andtheredonotexistcompetentcandidatesofChinesenationalityforthetimebeing;employmentofforeignerstosuchjobpostsshallnotviolatetherelevantstipulationsofthecountry.ChapterIVPublicEmploymentServiceArticle24Laborsecurityadministrativedepartmentsabovethecountylevelmanagetheworkofpublicemploymentserviceintheirownadministrativeareas,establishandimprovethepublicemployment servicesystemsthatcoverurbanandruralareasinaccordancewiththedevelopmentplanformulatedbythegovernment.Publicemploymentserviceorgans,accordingtotheemploymentobjectivesandtasksdeterminedbythegovernment,developemploymentserviceplan,promotetheimplementationofemploymentsupportpoliciesbymeansoforganizingemploymentservicesforlaborersandemployersandprovidingsurveyanalysisofthehumanresourcesmarket,andmanagethepromotionofrelevantemploymentissuescommissionedbylaborsecurityadministrativedepartments.Article25Publicemploymentserviceorgansshouldprovidethefollowingservicestolaborersfreeofcharge:1.Theconsultationofemploymentpoliciesandregulations;2.Theissuanceofinformationofjobsupplyanddemand,salaryinstructioninlabormarket,andcareertraining;3.Careerinstructionsandrecommendations;4.Theimplementationofemploymentassistanceforthoseinemploymentdifficulties; 5.Thetransactionofemploymentandunemploymentregistrationandetc;6.Otherpublicemploymentservices.Article26Publicemploymentservicesorgansshouldactivelyexpandservicefunctions,andprovidethefollowingservicesinaccordancewiththeneedofemployingunits:1.Theinstructionsofemployingpersons;2.TheActingemploymentservices;3.Thetrans-regionalemploymentservices;4.ManagementConsultingofenterpriseHumanResourcesandotherprofessionalservices;5.Actingasagentforlaborsecuritybusiness;6.Otheremploymentserviceitemsmeetingthedevelopmentneedsoftheemployingunits.Publicemploymentserviceorganscannotengageinlaborsecuritybusinessunlesstheyareauthorizedbythelaborsecurityadministrativedepartmentsabovecountylevel.Article27Publicemploymentserviceorgansshouldstrengthencareerinstructionservicesbypreparingthefull-timepart-time.careerstafftoprovidecareerinstructionservicesforthelaborerandtheemployingunits.Careerinstructionstaffshouldstartworkunlesstheyobtainthecorrespondingnationalcareerqualificationcertificatesafterprofessionalqualificationsandpassingtheevaluations.Publicemploymentserviceorgansshouldprovidecorrespondingfacilitiesandconditionsforcareerinstructionservicestopromoteexpansionandstrengthenitspublicity.Article28Careerinstructionservicesshouldincludethefollowing:1.Providinginformationontherelevantstatelawsandregulations,andpoliciesoflaborsecurity,andhumanresourcesmarketforthelaborerandtheemployingunits;2.Helpinglaborersunderstandoccupationalstatus,masterthemethodsofjobhunting,determinecareerdirection,andenhancetheabilitiestochooseacareer;3.Offeringtrainingsuggestionstolaborersandprovidingcareertrainingandotherrelevantinformation;4.Developingtestsforlaborersontheirindividualcareerqualityandcharacteristicsandgivinganevaluationoftheircareerability;5.Providingspecializedcareerinstructionservicesforwomen,thedisabled,ethnicminoritypersonnel,retiredofficersandsoldiers,andotheremploymentgroups; 6.Providingconsultingcareerinstructionservicesforstudentsofsecondaryschools,careerinstitutionsandtechnicalschools;7.Providingadvisoryservicesforlaborerswhoarewillingtoengageintheindividualindependentlaborandprivateenterprises;8.Providingpersonnelemploymentguidanceforemployingunitstochooseemploymentmethodsanddetermineemploymentconditions,criteria,etc;9.Provideadvisoryinformationforcareertraininginstitutionstoestablishtrainingdirectionandprofessionalsetupandetc;Article29Publicemploymentserviceorgansshallorganizeandimplementtheinvestigationofhumanresourcesandthesituationofemploymentandunemploymentstatisticsundertheguidanceoflaborsecurityadministrativedepartments.Article30Publicemploymentserviceorgansshallorganizeandimplementspecialplansaimingatdifferentneedsofparticularemploymentgroups.Article31Publicemploymentserviceorgansabovecountylevelestablishcomprehensiveservicelocationtoprovideaconcentratedsingle-stopemploymentservicesforlaborersandemployingunits,andtakeonotheraffairsorganizedbylaborandsocialsecurityadministrativedepartments.Employmentserviceorgansintheneighborhood,town,andcommunitiesshallestablishwaysofgrassrootsservicetodevelopemploymentassistancethatfocusonpublicemploymentservicesandimplementinvestigationsonhumanresources,andtotakeonotheremploymentserviceaffairsorganizedbylaborsecurityadministrativedepartments.Publicemploymentserviceorgansaretouseanationaluniformidentification.Article32Publicemploymentserviceorgansshouldconstantlyimprovethequalityandefficiencyoftheirservices.Publicemploymentserviceorgansshouldstrengtheninternalmanagement,improveservicefunctions,unifytheserviceprocedure,andprovidegoodandefficientemploymentservicesforlaborersandemployingunitsaccordingtothenormsandstandardsformulatedbythestate.Publicemploymentserviceorgansshouldenhancestafftrainingonpolicies,businessandserviceskills,andorganizecareerinstructingpersonnel,careerinformationanalysts,politicalassistantsoflaborandsocialsecurity,andotherprofessionalstoparticipatethecorrespondingcareerqualificationtraining.Publicemploymentserviceorgansshouldmakepublictheservicesystemandvoluntarilyacceptpublicsupervision.Article33Laborsecurityadministrativedepartmentsandthepublicemploymentserviceorganizationsabovethecountylevelshouldestablishandimprovethehumanresourcesmarketinformationnetworksandrelatedfacilitiesinaccordancewiththeunifiedplanningoftheinformationconstructionoflaborsecurity.Publicemploymentservicesorgansshouldgraduallyimplementinformationmanagementandservices,realizeemploymentservices,unemploymentinsurance,informationsharingonjobtraining,andinformationsystemmanagementofpublicemploymentserviceswithinthecity,andgraduallyrealizeinteroperabilityandinformationsharingoninformationofsalaryandsocialinsurance.Article34Publicemploymentservicesorgansshouldsetupandimprovethehumanresourcesmarketinformationalservicesystemthroughimprovingtheissuanceinformationsystemofcareersupply-demand,salaryinstructioninlabormarket,andmarketanalysisofhumanresources,toprovidesupportforlaborersonchoosingajob,foremployingunitstorecruitstaffaswellasforthedevelopmentoftraininginstitutions. Article35Laborasecurityadministrativedepartmentsabovecountylevelshallrealizegraduallythehumanresourcesmarketinformationnetworkinginaccordancewiththeunifieddemandofinformationconstruction:thecityshould,inaccordancewithdatacenterbuildingrequirementsofthelaborsecurity,realizecentralizationandsharingofnetworkanddataresources;provinces,autonomousregionsshouldestablishaprovincialMonitoringCenterofhumanresourcesmarketinformationnetworktomonitormarketinformationinthearea;laborsecuritydepartmentshouldestablishaNationalMonitoringCenterofthehumanresourcesmarketinformationnetworktomonitorandanalyzethenation'shumanresourcesmarketinformation.Article36Laborsecurityadministrativedepartmentsabovecountylevelshouldstrengthenthemanagementofpublicemploymentserviceorganizationsandmakeperformanceappraisalsforcompletionofvarioustasksatregularintervals.Article37Theoperatingfundsforpublicemploymentservicesshallbeincludedinthefiscalbudgetatthesamelevel.ThelaborandsocialsecurityadministrativedepartmentsatalllevelsandthepublicemploymentserviceorgansshouldworkoutanannualbudgetofpublicemploymentservicesunderthelawinaccordancewiththeprovisionsoffinancialbudgetandimplementitafterithasbeenauthorizedbytheFinancialDepartmentatthesamelevel.Inaccordancewithemploymentspecialfundsmanagementandrelatedregulations,publicemploymentserviceorganscanapplyforspecialsupportfundsforpubicemploymentservicesaccordingtothelaw.Publicemploymentservicestoacceptdonationsandfundingprovidedbyallcircles,manageandusetheminaccordancewithrelevantstatelawsandregulations.Asfortheservicesprovidedtotheemployingunits,publicemploymentserviceorgansshouldstandardizetheirmanagementandstrictlycontrolservicecharges.Wherechargesareunavoidable,theprovinciallaborsecuritydepartmentsinconjunctionwithrelevantdepartmentsaretoregulatethespecificitems.Article38Publicemploymentserviceorgansshallnotengageinoperationalbusiness.Publicemploymentserviceorgansarenottocollectservicechargesfromlaborersduringemploymentfairs.Article39EmploymentserviceorgansforthedisabledthatbelongtotheAssociationfortheHandicappedarecomponentsofpublicemploymentserviceorganizations,responsibleforprovidingrelevantemploymentservicesforthedisabledlaborersand,afterbeingcommissionedbythelaborsecurityadministrativedepartments,undertakeemploymentandunemploymentregistrationsforthedisabled.ChapterVEmploymentAidsArticle40Publicemploymentserviceorgansshoulddevelopspecialemploymentaidprograms,implementprioritizedsupportandemphasishelptoemploymentaidobjects.EmploymentaidobjectsinthisRegulationincludeindividualswithdifficultiesingettingemployedandzero-employmentfamilies.Individualshererefertothosewhofacedifficultiesingettingemployedbecauseoftheirphysicalcondition,levelofskills,familyfactors,thelossoflandandetc,andthosewhohavebeenunemployedforaprolongedperiodoftime.Zero-employmentfamilieshererefertocitydwellerswithmemberswhoareofstatutoryworkingageandarestillnotemployed.Theemploymentaidobjectsaredeterminedbyprovinciallaborsecurityadministrativedepartmentsinaccordancewiththescopeoftheaidobjectsregulatedbylocalpeople'sgovernment. Article41Individualswithdifficultiesingettingemployedandzero-employmentfamiliescanapplyforemploymentaidtopublicemploymentserviceorganslocatedintheneighborhoodsandcommunitiesandcanbeplacedintothescopeofemploymentaidafterbeingconfirmedbytheorganizations.Article42Publicemploymentserviceorgansshouldestablishasystemtohelpindividualswithemploymentdifficultiesbyimplementingvariousemploymentsupportpolicies,providingjobinformation,andorganizingskillstrainingandsoforth,aimingatemploymentservicesandemploymentaidforpublicwelfare,andimplementprioritizesupportsandtheemphasishelp.Individualswithemploymentdifficultiesallocatedtothepublicserviceshouldbegivenjobsubsidiesinaccordancewithstateregulations.Article43Publicemploymentserviceorgansshouldestablishanemploymentaidsystemtohelpzero-employmentfamiliesthroughbroadeningthescopeofpublicservicejobs,developingvariouskindsofjobsandothermeasures,totimelyprovideappropriatejobsforunemployedindividualsinthefamily,ensuringatleastonememberofthefamilytoobtainemployment.Article44Publicemploymentserviceorgansinneighborhoodsandcommunitiesshouldregisteremploymentaidobjectsinthearea,createaspecialaccountingjournal,andimplementdynamicmanagementforemploymentaidobjectsandaidaccountabilitytoprovidetimelyandeffectiveemploymentaid.ChapterVICareerIntermediaryServicesArticle45Laborsecurityadministrativedepartmentsabovethecountylevelshouldstrengthenthemanagementofcareerintermediaryorganizationsandencouragethemtoimproveservicequalitytofacilitateemployment.Employmentintermediaryorgansmentionedintheprovisions,refertooperationalorganizationsheldbylegalentities,otherorganizationsandindividualcitizenstoprovideintermediaryservices,andotherrelatedservicesforemployingunitshiringlaborersandforlaborersseekingemployment.Governmentdepartmentsarenotallowedtoholdoperationalemploymentintermediaryorgansindependently or withothers.Article46Careerintermediaryactivitiesshouldabidebythelaw,beofgoodfaith,befairandopeninprinciple.Anyorganization or individualshallnotusecareerintermediaryactivitiesagainstthelaborerandtheemployer'slegitimaterightsandinterests.Article47Careerintermediaryimplementstheadministrativepermissionsystem.Theestablishmentofoccupationalintermediary or otherorganstodevelopcareerintermediaryactivitiesissubjecttotheapprovalofthelaborsecurityadministrativedepartments,andobtainingcareerintermediarylicense.Careerintermediaryorganizationswhichareapprovedthecareerintermediarylicenseshouldregistertoindustrialandcommercialadministrativedepartment.Anyorganswithoutthelicenseandregistrationcannotengageincareerintermediaryactivities.CareerintermediarylicenseisprinteduniformlybytheMinistryofLaborandSocialSecurityanddistributedforfree.Article48Toestablishemploymentintermediaryorgans,thefollowingqualificationsshouldbereached:1.Clearcharterandmanagementsystems;2.Afixedlocation,officefacilities,andacertainamountofoperatingcapitalforactivities;3.Certainnumberofcertifiedfull-timestaff; 4.Otherconditionsasrequiredbylawandotherregulations.Article49Toestablishemploymentintermediaryorgans,thefollowingdocumentsshouldbesubmittedtothelocallaborsecurityadministrativedepartmentsabovethecountylevel:1.Theestablishmentapplication;2.Thedraftofinstitutioncharterandmanagementsystems;3.Thecertificationoftherighttousethevenue;4.TheCapitalVerificationReportoftheregisteredcapital;5.Detailsofthebasicinformationandidentityofthedirector;6.Appropriateprofessionalqualificationsofthefull-timestaff;7.Otherdocumentsasrequiredbylawandotherregulations.Article50Thelaborsecuritydepartmentshouldcompletetheapplicationsfromtheprofessionalintermediarieswithin20dayssincetheadmissibledate,thereafter,approvethosethatmeettherequirementsandgivethereasonsforthosethataredisapproved.Thelaborsecurityadministrativedepartmentsshouldappraiseannuallytheprofessionalintermediaries.Thespecificestablishmentconditions,theapprovalandtheannualappraisalproceduresontoprofessionalintermediariesareregulatedbytheprovinciallaborsecurityadministrativedepartments.Article51Thecareerintermediaryorganizationsthatchangesnames,location,andlegalrepresentative or terminate,andsoforth,shouldamend or canceltheregistrationformalitiesaccordingtotheapprovingestablishmentprocedures.Asforthebranchoffice,itshouldbeapprovedbylaborsecurityadministrativedepartmentsabovethecountylevelafterobtainingwrittenconsentfromtheoriginalapprovingbody.Article52Employmentintermediaryorganscanengageinthefollowingservices:1.Tointroduceemployingunitstothelaborers;2.Torecommendlaborerstotheemployingunitsandhouseholds;3.Toconductcareerguidance,humanresourcesmanagementconsultingservices;4.Tocollectanddisseminateoccupationalsupplyanddemandinformation;5.TooffertheInternetprofessionalinformationservicesinaccordancewithrelevantstateregulations;6.Toorganizecareeremploymentfairs;7.Toconductotherservicesapprovedbythelaborsecurityadministrativedepartments.Article53Professionalintermediariesshouldopenlydisplayoperatinglicenses,occupationallicenses,intermediaryservicelist,standardfees,thenameofoversightbodiesandtelephonenumberofsupervision,andacceptsupervisionandinspectionfromthelaborsecurityadministrativedepartmentsandotherrelevantdepartments.Article54Employmentintermediaryorgansshouldestablishanaccountingjournaltorecordserviceobjects,serviceprocesses,theresultsandservicecharges,andacceptthesupervisionandinspectionfromthelaborsecurityadministrativedepartments.Article55Whereemploymentintermediaryorgansareunsuccessfulinprovidingcareerintermediaryservices,servicechargescollectedfromintermediaryservicesshouldberefundedtothelaborers.Article56Whenlarge-scalecareeremploymentfairsareheld,professionalintermediariesshouldformulatecorrespondingmeasuresfororganizingandsecurityprogramofwork,andreporttotheorganizationsapprovingtheestablishment.Employmentintermediaryorgansshouldchecktheauthenticityoftheeligibilityofemployingunitsandtheiremploymentcharters. Article57Providingpublicemploymentservicesforspecificserviceobjects,employmentintermediaryorganscanaccordinglysubsidies.However,thescopeofpublicserviceemploymentservices,theserviceobjects,serviceeffectivenessandsubsidies,withinwhichthesubsidiesareattached,areregulatedbytheprovinciallaborsecuritydepartment,inconjunctionwithrelateddepartments.Article58Employmentintermediaryorgansareprohibitedfromthefollowingactions:1.Providingfalseemploymentinformation;2.Releasinganyinformationindicatingemploymentdiscrimination;3.Forgery,alteration,transferofprofessionalintermediarypermit;4.Providingcareerintermediaryservicesfortheemployingunitswithoutalegallicense;5.Providingemploymenttoadolescenceundertheageof16yearsold;6.Providingcareerintermediaryservicesforlaborerswithoutlegalidentitydocuments;7.Providingvocationsprohibitedinlawandregulations;8.Detainthelaborer'sidentitycardandotherdocuments, or collectingdeposits;9.Theuseofviolence,coercion,fraudandotherprofessionalmannerinintermediation;10.Exceedingtheapprovedscopeofserviceoperations;11.Otherviolationsoflaw or regulations.Article59Laborandsocialsecurityadministrationdepartmentsabovethecountylevelshouldsuperviseanddirectinaccordancewiththelawontheapprovedoccupationalintermediaryorgans,periodicallyappraisethecredibilityoftheservicesandservicequality,andreleaseappraisalresultstothepublic.Laborandsecurityadministrationdepartmentsabovethecountylevelshoulddirectprofessionalintermediariesinstafftrainingtoimprovetheservicequality.Laborandsecurityadministrationdepartmentsabovethecountylevel,afterapprovalfromthegovernmentatthesamelevel,shouldgiverecognitionandawardtooccupationalintermediaryinstitutionsandindividualswithoutstandingperformanceforintegrityservices,qualityservicesandpublicwelfareservices.Article60Foreign-fundedcareerintermediaryorgans,aswellasemploymentintermediaryorgansengagedinoutsideemploymentintermediaryservicesshouldoperateinaccordancewithrelevantregulations.ChapterVIIManagementofEmploymentandUnemploymentArticle61Laborsecurityadministrativedepartmentsshouldestablishandimproveemploymentregistrationsystemandunemploymentregistrationsystemandimprovethemanagementofemploymentandunemployment.Publicemploymentserviceorgansareresponsiblefortheregistrationofemploymentandunemployment,theestablishmentofspecializedaccountingtorecordchangesinemploymentandunemploymentamonglaborersaccuratelyintime,andmakecorrespondingstatisticalwork.Employmentregistrationandregistrationoftheunemployedintheprovinces,autonomousregionsandmunicipalitieswithinshouldadoptemploymentandunemploymentregistrationcertificateshereinafterreferredtoasregistrationcertificatesinaunifiedmanner,whicharedistributedfreetolaborers,clearlystatingthecorrespondingannotatedsupportpolicy.Employmentregistrationandregistrationoftheunemploymentproceduresandthespecificregistrationformsareformulatedbytheprovinciallaborandsocialsecurityadministrationdepartment.Article62Theemployingunitsshouldprocesstheemploymentregistrationforlaborerswhoareemployedbythem.Theemployingunits,whodeterminethetermination or dissolutionoflaborrelations, shouldgotothelocalpublicemploymentserviceorganizations,filingforlaborersandapplyingemploymentregisterforlaborers.Employingunitsshouldcompletetheregistrationprocedureswithin30daystohiring;Employingunitsshouldcompletetheregistrationprocedureswithin15daystoterminatingthelaborrelations;Laborerswhoareengagedinindividualbusinesses or flexibleemploymentshouldcompletetheiremploymentregistrationintheneighborhoods,townshippublicemploymentserviceorgansthemselves.Employmentregistrationaretocontaininformationsuchaspersonalinformation,employmenttypes,dateofemployment,employingunitsandthesituationofestablishment,termination or dissolutionofthelaborcontract.Specificcontentandmaterialsrequiredforemploymentregistrationareregulatedbytheprovinciallaborsecurityadministrativedepartment.Publicemploymentservicesorgansshouldsetupwaysofspecialservicesfortheemploymentunitstoapplyforemploymentandassociatedregistrationproceduresandsimplifytheprocedurestofacilitateemploymentunits.Article63Unemployedurbanpermanentresidentstaffofthestatutoryworkingageandtheabilitytoworkcangotothepublicemploymentserviceorgansforunemploymentregistrationiftheyarelookingforemployment.Amongthem,urbanhouseholdregistrationstaffwithnojobexperienceregisteratwherehisresidenceisregistered;ruralmigrantlaborersandnon-permanentresidentcanregisterattheircurrentplaceofresidenceprovidingtheyhadatleastsixmonthsofpriorstableworkattheircurrentplaceofresidencebeforebecomingunemployed.  Article64Laborersshouldpresentpersonalidentitypaper or relevantproofofpersonalidentitywhenregisteringforunemployment;laborerswiththeworkexperienceshouldprovideproofofterminationfromthepriorunit,proofofterminationoflaborrelations or proofofdismissal.Registeredunemployedpersonswhohavearegistrationcertificatecanhavethebenefitofpublicemploymentservicesandemploymentsupportpolicies,andthosewhomeettheconditionscanapplyforunemploymentinsuranceinaccordancetotheregulations.Registeredunemployedpersonsshouldregularlyreporttothepublicemploymentserviceorganstheiremploymentstatus,activelyseekjobs,andparticipateinjobtrainingofferedbythepublicemploymentserviceorgans.Article65Thecriteriaofunemploymentareasfollows:1.Atleast16yearsold,havinggraduated or completedschoolingfrominstitutions;2.Dismissedfromenterprises,organizations,institutions,andothervariousemployingunits;3.Individualindustrialandcommercialowners or ownersofprivateenterprisessufferingfromclosureandbankruptcy;4.Contractorlandbeingtakeninlinewithprovisionsoflocalconditions;5.Soldiersreleasedfromactivedutyandnotyetintegratedintonationalreunificationresettlement;6.Ex-convictandparolee, or thosewhohavebeenexemptedfromre-educationthroughlabor;7.Unemployedpersonsidentifiedbyindividualregions.Article66Registeredunemployedpersonswillbewrittenofftheregistrationoftheunemployedbythepublicemploymentserviceorgansinanyoneofthefollowingcases:1.Employedbyemployingunits;2.Engageinindividualbusinesses or self-employedinenterpriseswithanindustrialandcommercialbusinesslicense;3.Engageinworkwithasteadyincome,andthemonthlyincomeisnotlessthanthelocalminimumwagestandards; 4.Accesstobasicold-ageinsurancebenefits;5.Completelossofworkingability;6.Admittedintoschools,militaryservice, or resettledabroad;7.Sentencedtojail or re-educationthroughlabor;8.Terminateemploymentrequirements or refusetoacceptpublicemploymentservices;9.Nocontactwithpublicemploymentserviceorganizationsforsixmonthsinsuccession;10.Registeredforemployment, or otherconditionsprescribedbylocalregulations.ChapterVIIISanctionArticle67EmployingunitsviolatingClause2and3ofArticle14oftheprovisionsoftheLaborContractLawwillbepenalizedinaccordancetotheprovisionsofArticle84;employingunitsviolatingtheregulationsofClause4ofArticle14willbepenalizedaccordingtostatebanontheuseofchildlaborandotherrelevantlawsandregulations.FortheemployingunitsbreachingregulationsofClause1,5and6ofArticle14,afinewithin1,000Yuanwillbeimposedandthelaborsecurityadministrativedepartmentswouldorderareformation,andtheconcernedpartiesbeartheliabilityofdamagecaused.Article68IfemployingunitsviolatetheprovisionsofClause2ofArticle19inhiringlaborersthatthestatelawsandadministrativeregulationsandtheStateCouncil'shealthadministrativedepartmentsprohibit,i.e.;carriersofhepatitisBpathogen,thelaborsecurityadministrativedepartmentswouldorderareformation,andimposeafinewithin1,000Yuan;thepartiesshouldbeartheliabilityofdamagecaused.ThehealthadministrativedepartmentsunderStateCouncilwilltakeserumhepatitisBvirusIndexesasastandardmedicalexamination.Article69IfpublicemploymentserviceorgansviolatetheprovisionsofArticle38bycollectingservicechargesfromthelaborers,thelaborsecurityadministrationdepartmentswouldorderreformationwithinaspecifiedperiod;theorgansshallreturntheillegalservicechargestothelaborers,andreprimandtheresponsiblesupervisorypersonnel,andothersdirectly.Article70WheretheemploymentunitsviolatesArticle47ofthisRegulationbyengaginginactivitiesoftheemploymentserviceswithoutauthorityandregistration,thelaborsecurityadministrativedepartments or othercompetentauthoritieswouldtakepenaltiesinaccordancetoArticle64oftheEmploymentPromotionLaw.Article71WhereemploymentintermediaryorgansviolateArticle53ofthisRegulationbynotopenlydisplayintermediarylicenses or monitoringtelephonenumbers,thelaborsecurityadministrativedepartmentsshallorderthemtocorrect,andimposeafinenotmorethan1,000Yuan;astothosenotopenlydisplayservicecharges,theyshallbereportedtodepartmentsinchargeoftherelevantprovisionsforpenalties;astothosedonotopenlydisplayservicelicenses,theyshallbereportedtotheindustrialandcommercialadministrationdepartmentsforsanctionaccordingtorelevantstateregulations.Article72WheretheemploymentintermediaryorgansviolateArticle54ofthisRegulationbynotestablishinganaccountingjournal, or anaccountingjournalwithoutrecordsofclients,serviceprocess,servicechargesandtheresults,thelaborsecurityadministrativedepartmentsshallorderthemtocorrectandimposeafinenotmorethan1,000Yuan.Article73WhereemploymentintermediaryorgansviolateArticle55ofthisRegulationbyfailingtorefundtheservicefeechargedtothelaborersafterunsuccessfulintermediaryservices,thelaborsecurityadministrativedepartmentswouldorderthemtocorrectandimposeafinenotmorethan1,000Yuan.Article74WheretheemploymentintermediaryorgansviolateClause1,3,4,8ofArticle58ofthisRegulation,itshallbeimposedafineinaccordancetoArticle65,Article66oftheregulationsofthe EmploymentPromotionLawofPRC.IntermediariesviolatingtheprovisionsClause5ofArticle58oftheregulationswillbepenalizedinaccordancetonationalregulationsconcerningprohibitionoftheemploymentofchildlabor.IntermediariesviolatingtheprovisionsofArticle58andotherprovisions,thelaborandsocialsecurityadministrationdepartmentwouldorderreformationandifthereisnoillegalincome,imposefinesnotmorethan10,000Yuan;ifthereisillegalincome,imposefinesthatarenotmorethanthreetimestheillegalincome,maximumamountnotmorethan30,000Yuan.Iftheoffenseisserious,theauthoritiesmayrequiretheindustryandcommercedepartmentstorevoketheemployer'sbusinesslicense;Theemploymentunitshallcompensatethesufferedforanyconsequentloss.Article75WheretheemployingunitsviolateArticle62ofthisRegulationbynotregisteringlaborers'employmentintime,thelaborsecurityadministrativedepartmentsshallorderthemtocorrectandimposeafinenotmorethan1,000Yuan.ChapterIXSupplementaryProvisionsArticle76Laborsecurityadministrativedepartmentsinprovinces,autonomousregionsandmunicipalitiesmayformulateimplementingrulespursuanttothisRegulation.Article77TheseprovisionsshallbecomeeffectiveasfromJanuary1,2008.TheMeasuresofCareerGuidancepromulgatedbytheMinistryofLaboronOctober27,1994,theRegulationofLaborMarketManagementpromulgatedbytheMinistryofLaborandSocialSecurityonDecember8,2000shallbeabrogatedsimultaneously.
