3、arties.Forthesamereason,individualsandbusinessesdesiringtotradeuponthischaracteristicoftheInternetwilloftenregisterdomainnamesthataresimilaroridenticaltocommonlaworregisteredtrademarks.Somesuchusesarevalidandperfectlylegal,butmanyarenot.Thisisthefoundationforthedisputesdiscussedhere.TheConflic

4、t.Typicallythedisputeswediscusshereinvolveafactualdeterminationofwhethertheusesofthedomainarevalid;butasnotedbelow,thereareoftenotherfactsthatmustbeestablishedandotherissuesresolvedinordertoprevailinsuchcases.Thisconflictbetweenthepartiesinevitablyresultsinlitigationorarbitrationbetweenthemark

5、ownerandthedomainnameowner/user.Therulesforcommencementofsuchcasesandtheprocessofresolutionofthesedisputesisthesubjectofthispaper.CourtProceedingsLessPractical.WhilesuchdomainnamedisputescanbetakenintofederalcourtunderwhatiscalledtheACPAorAnticybersquattingConsumerProtectionAct,suchcourtlitiga

6、tionisexpensive,time-consumingandoftendifficulttopursuebecauseofjurisdictionalandothertechnicalissues.WebrieflydiscussheretheACPAandthereasonsonemightwishtouseitratherthantheUDRP.WhiletheUDRP,ontheotherhand,istheonlysignificantalternativetocourtlitigation,whichwasdevelopedandcommencedin1999byt
