1、IMPLEMENTINGREGULATIONSOFTHEPATENTLAWOFTHEPEOPLE'SREPUBLICOFCHINA(PromulgatedbyDecreeNo.306oftheStateCouncilofthePeople'sRepublicofChinaonJune15,2001,amendedthefirsttimeonDecember28,2002accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLa

2、wofthePeople'sRepublicofChina,andamendedthesecondtimeonJanuary9,2010accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeople'sRepublicofChina)TranslatedbytheStateIntellectualPropertyofficeofthePeople'sRepublicofChina.Incaseofdiscr

3、epancy,theoriginalversioninChineseshallprevail.ChapterIGeneralProvisionsRule1.TheseImplementingRegulationsareformulatedinaccordancewiththePatentLawofthePeople'sRepublicofChina(hereinafterreferredtoasthePatentLaw).Rule2.AnyformalitiesprescribedbythePatentLawandtheseImplement

4、ingRegulationsshallbecompliedwithinawrittenformorinanyotherformprescribedbythepatentadministrationdepartmentundertheStateCouncil.Rule3.AnydocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsshallbeinChinese;thestandardscientificandtech

5、nicaltermsshallbeusedifthereisaprescribedonesetforthbytheState;wherenogenerallyacceptedtranslationinChinesecanbefoundforaforeignnameorscientificortechnicalterm,theoneintheoriginallanguageshallbealsoindicated.Whereanycertificateorcertifyingdocumentsubmittedinaccordancewithth

6、eprovisionsofthePatentLawandtheseImplementingRegulationsisinaforeignlanguage,thepatentadministrationdepartmentundertheStateCouncilmay,whenitdeemsnecessary,requestaChinesetranslationofthecertificateorthecertifyingdocumentbesubmittedwithinaspecifiedtimelimit;wherethetranslati

7、onisnotsubmittedwithinthespecifiedtimelimit,thecertificateorcertifyingdocumentshallbedeemednottohavebeensubmitted.Rule4.WhereanydocumentissentbymailtothepatentadministrationdepartmentundertheStateCouncil,thedateofmailingindicatedbythepostmarkontheenvelopeshallbedeemedtobeth

8、edateoffiling;wherethedateofmailingindicatedbythepostmarkontheenvelopeisillegible,
