2、undertheStateCouncil ofthePeople'sRepublicofChina.Incaseofdiscrepancy,theoriginalversionshallprevail.)ChapterI GeneralProvisionsRule1.TheseImplementingRegulationsareformulatedinaccordancewiththePatentLawofthePeople'sRepublicofChina(hereinafterreferredtoasthePatentLaw).Rul
3、e2"Invention"inthePatentLawmeansanynewtechnicalsolutionrelatingtoaproduct,aprocessorimprovementthereof. "Utilitymodel"inthePatentLawmeansanynewtechnicalsolutionrelatingtotheshape,thestructure,ortheircombination,ofaproduct,whichisfitforpracticaluse. "Design"inthePate
4、ntLawmeansanynewdesignoftheshape,thepatternortheircombination,orthecombinationofthecolorwithshapeorpattern,ofaproduct,whichcreatesanaestheticfeelingandisfitforindustrialapplication.Rule3AnyformalitiesprescribedbythePatentLawandtheseImplementingRegulationsshallbecompliedwit
5、hinawrittenformorinanyotherformprescribedbythePatentAdministrationDepartmentundertheStateCouncil .Rule4 AnydocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsshallbeinChinese;thestandardscientificandtechnicaltermsshallbeusedifthereis
6、aprescribedonesetforthbytheState;wherenogenerallyacceptedtranslationinChinesecanbefoundforaforeignnameorscientificortechnicalterm,theoneintheoriginallanguageshallbealsoindicated. WhereanycertificateorcertifyingdocumentsubmittedinaccordancewiththeprovisionsofthePatentLa
7、wandtheseImplementingRegulationsisinaforeignlanguage,thePatentAdministrationDepartmentundertheStateCouncil may,whenitdeemsnecessary,requestaChinesetranslationofthecertificateorthecertifyingdocumentbesubmittedwithinaspecifiedtimelimit;wherethetranslationisnotsubmittedwithi
8、nthespecifiedtimelimit,thecertificateorcertifyingdocumentshallbedeemednottohavebeensubmit
