3、ed.Afterestablishingthefactthattheconflictinquestionfallsunderthelawandisad-missible,thesolepurposeofthecourtistosolvetheconflict.Thoseinvolvedincourtproceedingspresenttheirviewstothebestoftheirability.Thecourtthenhastomakechoicesbetweentheconflictingopinionsandanumberofc

4、ompetingpossiblelegalbases.Intheprocesstowardsthisgoal,oneimportantactoristheAdvocateGeneral.Inaninstitutionalsetting,argumentationtakespreferredstylesandcom-municativestrategies.Languageuseisunderstoodhereassocialpracticeandpersuasivelanguageuseasaninteractiveprocess.

5、Whodetermineswhattheproceduresthroughwhichcommunicativestrategiesbecomepreferredare,ishoweveroutsidethescopeofthisstudy.TheviewassumedinthischapterowesmuchtoBourdieu(1971and19773)inthatthedecisivefactoristhepres-tigeandvalueofsymboliccapital,thesymbolicmarket.Itshould,

6、however,bestressedthatintheviewadoptedhereitisnotacceptedthatlanguagecouldmerelybereducedtoasituationallydeterminedlistofexpressionsandformsassometimesseemstobethecaseforinstanceininformationandcommunica-tionstudies.AlthoughtheoldAristotelianobservationthatformandconte
