2、,whattheymean,fortheright-holderandforothersintermsofobligationsandburdens,isamatterofspecification.Onecouldtreatthisspecifica-tionasalegalquestion,theinterpretationoflegalprovisionsinstatutes,priordeci-sions,orpractices.Butthereisaquestioninmoralitythatshouldinfluencethatlegalspecificat
3、ion: whatisthemorallyjustifiedcontentofanyhumanright?Whatcanhold-ersofsuchrightslegitimatelyclaimfromothersand,correspondingly,whatmorallyjustifiedburdensdoesthisimplyforthoseothers?Oneschoolofthought,callitthedemocraticspecificationtradition,holdsthatatleastinpartthespecifiedmoralcon-te
4、ntofhumanrights,notjustthecontentoflegalrights,mustbewhatademocraticpoliticalcommunitydecidesittobe.Specifiedhumanrightsasmoralrights,then,arehybrids: inherentlymoralintheabstractbutinherentlypoliticalintheirspecification.1InwhatfollowsI challengethecogencyofthekeythesesofdemocraticspeci
