2、、原则性的，难以在实践上具体指导人民检察院对行政诉讼开展监督活动。因此，迫切需要对现行的检察机关行政诉讼法律监督制度加以发展和完善。文章首先从检察机关行政诉讼法律监督的概念切入，从监督的时间、监督的对象、监督的内容、监督的方式等四个方面阐述了检察机关行政诉讼法律监督的全面性。通过分析我国的宪政结构，探讨检察机关行政诉讼法律监督制度的宪政基础，为该制度寻求到了理论支撑。而后梳理了检察机关行政诉讼法律监督制度之现行法律规范，结合该项制度在实践中的运行状况，探究其在立法和实践两个方面存在的问题。最后结合实施检察机关行政诉讼法律监督制度所需注意的
