2、ternationalConventionfortheProtectionofNewVarietiesofPlants; (ii) "Actof1961/1972"meanstheInternationalConventionfortheProtectionofNewVarietiesofPlantsofDecember2,1961,asamendedbytheAdditionalActofNovember10,1972; (iii) "Actof1978"meanstheActofOctober23,1978,ofthe
3、InternationalConventionfortheProtectionofNewVarietiesofPlants; (iv) "breeder"means -thepersonwhobred,ordiscoveredanddeveloped,avariety, -thepersonwhoistheemployeroftheaforementionedpersonorwhohascommissionedthelatter'swork,wherethelawsoftherelevantContractingParty
4、soprovide,or -thesuccessorintitleofthefirstorsecondaforementionedperson,asthecasemaybe; (v) "breeder'sright"meanstherightofthebreederprovidedforinthisConvention; (vi) "variety"meansaplantgroupingwithinasinglebotanicaltaxonofthelowestknownrank,whichgrouping,irrespe
5、ctiveofwhethertheconditionsforthegrantofabreeder'srightarefullymet,canbe -definedbytheexpressionofthecharacteristicsresultingfromagivengenotypeorcombinationofgenotypes, -distinguishedfromanyotherplantgroupingbytheexpressionofatleastoneofthesaidcharacteristicsand -
6、consideredasaunitwithregardtoitssuitabilityforbeingpropagatedunchanged; (vii) "ContractingParty"meansaStateoranintergovernmentalorganizationpartytothisConvention; (viii) "territory,"inrelationtoaContractingParty,means,wheretheContractingPartyisaState,theterritoryo
7、fthatStateand,wheretheContractingPartyisanintergovernmentalorganization,theterritoryinwhichtheconstitutingtreatyofthatintergovernmentalorganizationapplies; (ix) "authority"meanstheauthorityreferredtoinArticle30(1)(ii); (x) "Union"meanstheUnionfortheProtectionofNew
