1、Thefollowaretheconditionsandexceptionshereinbeforereferredto:1.DEFINTION.“Merchant”includestheShipper,theReceiver,theConsignor,theconsignee,theHolderoftheBillofLadingandtheOwneroftheGoods.2.JURISDICTION.AlldisputesarisingunderandinconnectionwiththisBillofLadingshallbesettledintheflag–stateoft
2、heship,orotherwiseintheplacemutuallyagreedbetweentheCarrierandtheMerchant.3.PARAMOUNTCLAUSE.ThisBillofLadingshallbesubjecttotheHagueRulescontainedintheInternationalConventionfortheUnificationofCertainRulesoflawRelatingtoBillsofLading,datedatBrusselsthe25thAugust1924,orthecorrespondinglegislat
3、ionoftheflagstateoftheship.IfthestipulationofthisBillofLadingarewhollyorpartlycontrarythereto,thisBillofLadingshallbereadasifsuchstipulationorpartthereof,asthecasemaybe,weredeleted.4.PERIODOFRESPONSIBILITY.TheresponsibilityoftheCarriershallcommencefromthetimewhenthegoodsareloadedonboardtheves
4、selandshallceasewhentheyaredischargedfromthevessel.TheCarriershallnotbeliableforlossofordamagetothegoodsbeforeloadingandafterdischargingfromthevessel,howsoeversuchlossordamagearises.5.PACKINGANDMARKS.TheMerchantshallhavethegoodsproperlypackedandaccuratelyandclearlymarkedbeforeshipment.Theport
5、ofdestinationofthegoodsshouldbemarkedinlettersnotlessthan5cmhigh,insuchawayaswillremainlegibleuntiltheirdelivery,AllfinesandexpensesarisingfrominsufficiencyorinadequacyofpackingormarksshallbebornebytheMerchant.6.FEIGHTANDOTHERCHARGES.(1)Advancefreighttogetherwithotherchargesisdueonshipment.If
6、notprepaid.Thoughstipulated,thefreightandotherchargesshallbepaidbytheMer-chantplus5%interestperannumrunningfromthedateofnotificationfortheirpayment,Ifthecargoshippedareperishables,lowcostgoods,liveanimals,deckcargoorgoodsforwhichthereisnoCarrier’sagentattheportofdestination,thefreightforsuchc
7、argoandallrelatedchargesshallbepaidatthetimeofshipment.Freightpayableatdestinationtogetherwithotherchargesisdueonvessel’sarrival.Advancefreightand/orfreightpayableatdestinationshallbepaidtotheCarrierinfull,andnon-returnableandnon-deductableir
