2、tomstaketoprotectabusiness’sintellectualpropertyrights?Ononehand,iftheCustomsdiscoversthatanyimportorexportgoodsaresuspectedofinfringinganyintellectualpropertyright(“IPR”)recordedwiththeGeneralAdministrationofCustoms(“GAC”),GACshallimmediatelynotifytherelevantIPRownerinwritingofsuchmatter
3、.Ontheotherhand,ifanIPRownerdetectsthatanygoodssuspectedofIPRinfringementwillbeimportedorexportedsoon,theIPRownercanalsoapplytotheCustomsfortheseizureofsuchgoodsaslongastheIPRownerprovidesasecuritydepositequivalenttothevalueofthegoodstobeseizedandpaysforthewarehousing,keepinganddisposalfe
4、esincurredinconnectionwiththeseizure.II.HowtorecordtheIPRwiththeCustoms?InordertobeeligiblefortheprotectionsofferedbytheCustoms,abusinessentityshallsubmitanapplicationtoGACinproperforminaccordancewithArticle7oftheRegulation,which,amongotherthings,requeststherecordaloftheIPRownedbyit(inclu
5、dingtrademarks,copyrightsorothercopyright-relatedrights,orthepatents).GACwilldecidewhethertograntarecordaloftheIPRatissuewithinthirty(30)daysafterreceivingthefullsetofapplicationdocuments.AnIPRrecordal,ifgrantedbyGAC,willbevalidforten(10)years.Suchrecordaltermcanbeextendedforanotherten(10
6、)yearsiftheIPRownerappliesforanextensionsix(6)monthspriortotheexpirationoftheoriginalrecordalterm..III．WhatactionscananIPRownertakeaftertheCustomsseizesthesuspectedproducts?AfterapplyingfortheprotectivemeasuresfromtheCustoms,anIPRownermayapplytothecompetentcourtforacease-and-desistorderto
7、stoptheinfringementorcertainpreliminarypropertypreservativemeasures.IftheCustomsreceivesanenforcementassistancenoticefromthecourt,itwillassisttheimplementationofthecease-and-desistorderorpreliminarypropertypreservativemeasures.However,iftheCustomsdoesnotreceiveanenf
