1、死刑论文：论我国死刑复核程序的完善【中文摘要】死刑作为当今世界饱受争议的刑罚方式,如今在整个世界司法界被逐步削弱,甚至废除。我国作为死刑合法化国家的其中之一,旨在通过死刑刑罚制度弘扬社会正义、维护司法公正。死刑复核程序是我国为了监督死刑刑罚适用所设置的特殊程序,由我国最高人民法院以及高级人民法院在死刑(死缓)案件一审、二审后,判决生效前对案件进行最后核查,并裁定其是否予以执行。作为涉及剥夺被追诉者生命权利案件的最终审核程序,死刑复核程序可谓“生死攸关”。虽然现行死刑复核程序在我国司法界多年的改善下运行良好,但其仍然在争取“少杀”、评议规则、审理
2、期限、监督体制、以及参与方式等几方面存在比较严重的缺陷,需要及时的给予立法完善。本文通过对死刑程序理论及实践的深度剖析,建议我国有关立法机关应当赋予死刑复核程序以对死刑案件免刑、减刑的权力,升级现有评议规则,明确审理期限的上限与下限,完善对死刑复核的监督体制,并且将其审理方式确定为听证形式为主。此完善建议将使得我国现行死刑复核程序以及整个死刑刑罚体系变得更加完善、健全。【英文摘要】Asthemostdisputablecriminalpunishmentinthemoderngloballawsystem,theuseofdeathpenalt

4、reofdeathpenaltyreviewisaveryspecialprocessestablishedonlyinChina,whichintendstosupervisetheoperationofdeathpenalty.InChina,onlytheSupremePeople’sCourtandtheHigherPeople’sCourtareauthorizedtooperatetheprocedureofdeathpenaltyreviewafterfirstorsecondinstancewhichrelatedtoadeat
5、hpenalty,andtheprocedureexaminesthewholecaseforthelasttimeandgiveafinaldecisionofdeathexecution.Obviously,theprocedureofdeathpenaltyreviewisthefinalexaminationtothelawsuitsrelatedtodeathpenalty,whichmeansitisdefinitelyanimportantmatteroflifeordeath.Thoughthecurrentprocedureo
