1、受贿罪立法演革论文：我国受贿罪若干疑难问题研究【中文摘要】受贿罪是职务犯罪中最常见、最受关注的罪名之一,具有严重的社会危害性,是我国刑法重点打击的犯罪之一。刑法学界对受贿犯罪的理论研究也在逐步走向深入,但是无论理论上还是实践中,对受贿罪仍存在诸多分歧和争议。本文立足于我国刑法实践,结合刑法学的理论知识,针对新形势下受贿罪的发展变化,对受贿罪进行了比较全面的探讨,以期对我国打击受贿犯罪有所裨益。全文共分三个部分:第一部分:受贿罪的立法沿革。该部分首先从最基本的法律概念出发,介绍了受贿罪的概念和法律特征。在此基础上,详细考察了《刑法》确立以来关于受贿罪立法规定的变化,有利于更加直观地
2、了解受贿罪的发展及其历史背景。第二部分:受贿罪重点理论问题研究。该部分从受贿罪的行为对象入手,从理论和司法实践两方面探讨了贿赂的范围。同时,该部分针对新时期受贿犯罪行为的变化,本文还着重介绍了受贿罪的几种新型表现形式。第三部分:“关系密切的人”范围的认定。《刑法修正案(七)》之“关系密切的人”是由“近亲属”和“特定关系人”发展而来的。本文认为应尽快通过司法解释的形式对“关系密切的人”的含义作出科学权威的界定,对其作缩小解释。【英文摘要】Withserioussocialharmfulness,acommoncrimeofacceptingbribesasthetraditiona

5、rimeofacceptingbribelegislationcoursesincethedevelopmentofCriminalLawtohaveabetterunderstandingofthedevelopmentandhistoricalbackgroundofcrimeofacceptingbribes.Thesecondpart:Researchonthedisputedproblemsofcrimeofacceptingbribes.Thispartcarriesoutthestudyoftargetofcrimefromtwoaspectsoftheoryand
