1、AGREEMENTONDISPUTESETTLEMENTMECHANISMOFTHEFRAMEWORKAGREEMENTONCOMPREHENSIVEECONOMICCO-OPERATIONBETWEENTHEPEOPLE'SREPUBLICOFCHINAANDTHEASSOCIATIONOFSOUTHEASTASIANNATIONSTheGovernmentofthePeople'sRepublicofChina(“China”)andtheGovernmentsofBruneiDarussalam,theKingdomofCambodia,theRepublicofIndo

2、nesia,theLaoPeople'sDemocraticRepublic(TaoPDR”)，Malaysia,theUnionofMyanmar,theRepublicofthePhilippines,theRepublicofSingapore,theKingdomofThailandandtheSocialistRepublicofVietNam,MemberStatesoftheAssociationofSoutheastAsianNations(“ASEAN”),(collectively,“theParties",orindividuallyreferringto

3、anASEANMemberStateortoChinaasa“Party”)；RECALLINGtheFrameworkAgreementonComprehensiveEconomicCooperation(utheFrameworkAgreemenf)betweenChinaandASEANsignedbytheHeadsofGovernment/StateofChinaandASEANMemberStatesinPhnomPenhonthe4thdayofNovember2002;RECALLINGparagraph1ofArticle11oftheFrameworkAg

4、reementontheestablishmentofappropriateformaldisputesettlementproceduresandmechanismforthepurposesoftheFrameworkAgreementwithin1yearafterthedateofentryintoforceoftheFrameworkAgreement;HAVEAGREEDASFOLLOWS:ARTICLE1DefinitionsForthepurposesofthisAgreement,thefollowingdefinitionsshallapplyunlesst

5、hecontextotherwiserequires:(a)AllthedefinitionsintheFrameworkAgreementshallapplytothisAgreement;(b)“days”meanscalendardays,includingweekendsandholidays;(c)“partiestoadispute”，"partiestothedispute0,or“partiesconcerned”,meansthecomplainingpartyandthepartycomplainedagainst;(d)"complainingparty"

6、meansanypartyorpartiesthatrequestsforconsultationsunderArticle4;and(e)“partycomplainedagainst”meansanypartytowhichtherequestforconsultationsismadeunderArticle4.ARTICLE2ScopeandCoverage1.ThisAgreementshallapplytodisputesarisingundertheFrameworkAgreementwhichshallalsoincludetheAnnexesandthecon

7、tentstherein.Hereinafter,anyreferencetotheFrameworkAgreementshallincludeallfuturelegalinstrumentsagreedpursuanttoitunlesswherethecontextotherwiseprovides.2.AnyspecialoradditionalrulesandproceduresondisputesettlementcontainedintheFrameworkAgreementm
