2、heLaoPeople'sDemocraticRepublic("LaoPDR"),Malaysia,theUnionofMyanmar,theRepublicofthePhilippines,theRepublicofSingapore,theKingdomofThailandandtheSocialistRepublicofVietNam,MemberStatesoftheAssociationofSoutheastAsianNations(“ASEAN”),(collectively,“theParties”,orindividuallyreferringtoanASEANMember
3、StateortoChinaasa“Party”);RECALLINGtheFrameworkAgreementonComprehensiveEconomicCo-operation(“theFrameworkAgreement”)betweenChinaandASEANsignedbytheHeadsofGovernment/StateofChinaandASEANMemberStatesinPhnomPenhonthe4thdayofNovember2002;RECALLINGparagraph1ofArticle11oftheFrameworkAgreementontheestabli
4、shmentofappropriateformaldisputesettlementproceduresandmechanismforthepurposesoftheFrameworkAgreementwithin1yearafterthedateofentryintoforceoftheFrameworkAgreement;HAVEAGREEDASFOLLOWS:ARTICLE1DefinitionsForthepurposesofthisAgreement,thefollowingdefinitionsshallapplyunlessthecontextotherwiserequires
5、:(a)AllthedefinitionsintheFrameworkAgreementshallapplytothisAgreement;(b)“days”meanscalendardays,includingweekendsandholidays;(c)“partiestoadispute”,“partiestothedispute”,or“partiesconcerned”,meansthecomplainingpartyandthepartycomplainedagainst;(d)“complainingparty”meansanypartyorpartiesthatrequest
6、sforconsultationsunderArticle4;and(e)“partycomplainedagainst”meansanypartytowhichtherequestforconsultationsismadeunderArticle4.Page17of17ARTICLE2ScopeandCoverage1.ThisAgreementshallapplytodisputesarisingundertheFrameworkAgreementwhichshallalsoincludetheAnnexesandthecontentstherein.Hereinafter,anyre
