1、ARTICLE1.0RECOGNITIONANDPROCEDURALMATTERS1.1ThisCollectiveAgreementisnegotiatedundertheprovisionsoftheRecognitionAgreementof1965signedbytheEmployerandtheUnionon18thMay1965("theBargainingAgreement")andtheIndustrialRelationsAct1970(Chapter321,StatuteLawofTheBahamas,2000RevisedEdition)("TheIndustrial

2、RelationsAct")andamendments.Itspurposeistofix,foritsduration,remuneration,termsandconditionsofserviceandotheralliedmattersinrespectofmembersoftheBargainingUnit,subjecttoanylimitationsandexceptionscontainedintheRecognitionAgreement1.2TheUnionacknowledgesthattheteachersinthepublicschoolsystemareteac

3、hersinthepublicserviceandthattheirgeneralappointmentandconditionsofservicearegovernedbytheRegulationsinforceinthatbehalf,includingthePublicServiceCommissionRegulationsandregulationsmadeundertheEducationActoranyotherwrittenlaw.TheprovisionsofGeneralOrders(1992RevisedEdition)shallapplytoallpublicoff

4、icersemployedbytheMinistryofEducationwithinthepublicschoolsystem,excepttotheextentthatthisAgreementderogatesfromanynon・legislativepolicycontainedinGeneralOrderstoaddressthespecialcircumstancesoftheteachingprofession.1.3ThepartiesagreethattheEmployerandtheUnionwithinone(1)yearofsigningthisagreement

5、willbegindiscussionsontheestablishmentandtheimplementationofaTeachingServiceAuthority.1.4TheEmployerandtheUnionagreethatlegislationwillbedraftedfortheestablishmentofaTeachingServiceAuthoritywithinone(1)yearafterthesigningthisagreement.1.5TheEmployerrecognizestheUnionasthesolebargainingagentforthem

6、embersoftheBargainingUnitinconformitywiththeRecognitionAgreementof1965andtheCollectiveBargainingAgreement2005-2010.1.6ThetotalnumberofUnionandEmployerrepresentativesatanynegotiationsshallnotexceedseven(7)oneachside.However,inadditiontosuchrepresentatives,eachsidemayincludeamaximumoftwo(2)additiona

7、lrepresentatives,comprisinganyofthefollowing:consuitants,advisorsorobservers・Bothsidesmayhaveasecretaryormayelecttouseajointsecretarytorecordproceedings.BothUnionandEmployershallnotifytheotherinwritingofthenameso
