1、ChinaPacificPropertyInsuranceCo.,Ltd.PublicLiabilityInsuranceClausesGeneralProvisionsProvisionIThisInsuranceContract(hereinatterreferredtoas“Contract")consistsofInsuranceClauses,InsuranceApplication,InsurancePolicyorotherCertificatesofInsuranceaswellassuchotherinsuranceapplicationdocuments,state
2、ments,comments,affixedendorsementsorotherwrittendocumentsasrelatedhereto.Anyandallsucharrangementsasinvolvedhereundershallbemadeinwriting.ProvisionIIAnyandallgovernmentalagencies,enterpriseandpublicinstitutions,socialgroups,individualeconomicorganizationsandotherlegallyestablishedorganizationswi
3、thintheterritoryofthePeople'sRepublicofChina(exclusiveofHKSAR,MacaoSARandTaiwan,thesameappliesbelow)aredeemedtobequalifiedenoughtobetheInsuredhereunder.InsurancecoverageProvisionIIIDuringtheinsuranceperiodandwithinsuchscopeofareasasspecifiedherein,incaseofanyincidentasaresultoftheInsured'sneglig
4、eneeduringthecourseofitsrunninganybusinessactivitiesoritsownbusiness,whichincidenthascausedthird-partypersonalinjuriesand/orpropertydamagesandthesufferer(s)raises/raiseclaimsthefirsttimeeverduringtheinsuraneeperiod,theInsurershallundertaketopaytheindemnificationshereunderagainstanysuchindemnific
5、ationliabilityastobebornebytheInsuredinaccordaneewiththelawsofthePeople'sRepublicofChina(exclusivethelawsofHKSAR,MacaoSARandTaiwan,thesameappliesbelow).ProvisionIVIntheeventofanyinsuredaccident,asaresultofwhicheitherarbitrationorlitigationhasbeenraisedagainsttheInsured,theInsurershallalsotakesuc
6、hliabilityastomakeindemnificationshereunderagainstanysucharbitrationorlitigationexpensesasimposedontheInsuredaswellasthoseothernecessaryandreasonablefees(hereinafterreferredtoaslegalFees"),whichshallbepaidbytheInsurerasperthepriorwrittenconsent.ExclusionsProvisionVInthecaseofanyofthefollowingcir
7、cumstances,theInsurershallnotundertaketopayanyindemnification:(I)Suchanimals,bicycles,cars,locomotives,vesselsofanykind,aircrafts,lifts,elevators,escalators,cranes,hoistsorotherliftingmachinerywhichbelongtoorareinthepossessi
